Notice of Public Comment Extended for Draft Program Policy on Guidelines for Inspecting and Certifying Secondary Containment Systems of Aboveground Petroleum Storage Tanks at Major Oil Storage Facilities (DER-17).
Notice is hereby given that the New York State Department of Environmental Conservation (NYS DEC) has prepared a draft program policy regarding guidelines for inspecting and certifying secondary containment systems of aboveground petroleum storage tanks at major oil storage facilities (MOSF). This initial notification was published in the Environmental Notice Bulletin (ENB) on October 1, 2008 with a 30 day public comment period. This public comment period has been extended, and written comments regarding this draft policy will be accepted until Friday, December 5, 2008. 6 NYCRR Part 200, General Provisions
Pursuant to Environmental Conservation Law (ECL) Sections 1-0101, 3-0301, 19-0103, 19-0105, 19-0107, 19-0301, 19-0303, and 19-0305, the New York State Department of Environmental Conservation (NYS DEC) hereby gives notice of the following:
This purposed rulemaking will update 6 NYCRR 200.10, Table 4 to incorporate by reference each of the new and amended National Emission Standards for Hazardous Air Pollutants (NESHAP) regulations as they were printed in the July 1, 2007 Code of Federal Regulations and to correct existing typographical errors. 6 NYCRR 200.9 will also be updated to reflect the new references in Section 200.10. Pursuant to Section 112 of the Clean Air Act of 1990, New York State will implement and enforce all requirements under Section 112 for NESHAPs.

Notice is hereby given that the New York State Department of Environmental Conservation (Department or NYS DEC), will hold legislative public hearings on amendments to the proposed rule Part 200, General Provisions, pursuant to Environmental Conservation Law, Sections 1-0101, 3-0301, 19-0103, 19-0105, 19-0107, 19-0301, 19-0303, and 19-0305.
Part 200 is being revised to incorporate new and amended Federal National Emissions Standards for Hazardous Air Pollutants which appear in the July 1, 2007 Code of Federal Regulations Part 63 and to correct existing typographical errors in Section 200.10, Table 4. Section 200.9 will also be updated to reflect references in Section 200.10.
Pursuant to Part 617 of the implementing regulations for the State Environmental Quality Review Act, the Department has prepared a Negative Declaration stating that the proposed actions will not have a significant adverse effect on the environment.
