Project Description:

The applicant proposes an existing discharge of 15,000 gpd of sanitary wastewater to a Tributary of Crooked Lake from a septic tank with a sand filter at the applicant's facility located at 1 Song Mountain Road, Town of Preble, Cortland County.

The permit application is for a previously permitted discharge. Proposed modifications to the permit include increased monitoring requirements for BOD5 and suspended solids (from twice per year to once per quarter). Quarterly monitoring requirements have been added for nitrogen, ammonia, phosphorus and TKN-nitrogen. Weekly monitoring for temperature, pH and settleable solids has been added. Monthly discharge monitoring reports will be required. And, the Discharge Notification Act (DNA) requirements have been included in the permit, which require installation of a DNA sign at the outfall of the facility.

The Department has made a tentative determination to issue a State Pollutant Discharge Elimination System permit under Article 17 of the Environmental Conservation Law. This tentative determination indicates that a discharge regulated under this statute is considered to satisfy regulatory standards for permit issuance, based on information available to the Department at this time. As a tentative determination, the Department seeks comments on the proposed regulated activity prior to making a final decision on permit issuance. As such, this tentative determination does not signify department approval for or endorsement of the activity for which a permit is sought or for the overall proposed project. Project Description:

The Department is proposing to modify the SPDES permit for the Nine Mile Point Nuclear Station. Nine Mile Point is a two unit boiling water nuclear reactor with a total electrical generation output of approximately 1800 MW. Cooling water for both units is from Lake Ontario. Unit 1 utilizes a once through cooled design and has a maximum flow of 418 MGD. Unit 2 utilizes a closed-cycle cooling system and has maximum flow of 72 MGD. This SPDES permit authorizes the discharge of treated wastewater, contact and non-contact cooling water, stormwater, and sanitary wastewater. The SPDES permit also authorizes the withdrawal of cooling water from Lake Ontario for both units. The major modifications to the SPDES permit being contemplated by the Department include a reduction in the effluent limitations for residual oxidant, total copper, and total residual chlorine. In addition the modified permit reduces the mixing zone from 425 acres to 300 acres. The modified permit also includes the addition of conditions related to biological monitoring. The biological monitoring requirements include a review of additional technologies and operational measures to further minimize aquatic impacts from the intake. The information is being requested pursuant to 6 NYCRR Part 704.5 and 40 CFR 125 - Subpart J. A copy of the draft permit and a detailed fact sheet summarizing the changes are available upon request.
