Project Description:

The Department has prepared a draft permits and made a tentative determination to approve the application to renew the Title IV and Title V permits for the Spagnoli Road Energy Center. In 2003 the facility received Title IV and Title V air permits, and a State Pollutant Discharge Elimination (SPDES) wastewater discharge permit allowing the construction and operation of the subject facility, but construction has not commenced to date. The current SPDES permit is valid until March 31, 2013. The Spagnoli Road Energy center is a new 250-megawatt (nominal) natural gas fired combined cycle electric power generation facility. The major components of the facility include one combustion turbine, GE7FA, one unfired heat recovery steam generator (HRSG), a single steam turbine generator, an air-cooled condenser, one exhaust stack, an electric fire pump and a 15,000 gallon aqueous (15% solution) ammonia tank. The proposed project site is located on the south side of Spagnoli Road, about 0.5 miles west of Route 110, in the southwest corner of the Town of Huntington, near the Nassau County-Suffolk County line, Suffolk County.

In accordance with 6NYCRR Parts 621.7(b)(9) and 201-6.4(c), the Administrator of the United States Environmental Protection Agency (USEPA) has the authority to bar issuance of any Title V Facility Permit if it is determined not to be in compliance with applicable requirements of the Clean Air Act or 6NYCRR Part 201.

Persons wishing to inspect the subject Title V files, including the application with all relevant supporting materials, the draft permit, and all other materials available to the DEC (the "permitting authority") that are relevant to this permitting decision should contact the DEC representative listed below. The Draft Permit and Permit Review Report may be viewed and printed from the Department web site at: http://www.dec.ny.gov/chemical/32249.html.

DEC will evaluate the application and the comments received on it to determine whether to hold a public hearing. Comments and requests for a public hearing should be in writing and addressed to the Department representative listed below. A copy of the Department's permit hearing procedures is available upon request or on the Department web site at: http://www.dec.ny.gov/permits/6234.html.

Project Description:

The applicant proposes to demolish an existing single story dwelling and to construct a new two-story dwelling 10' north of the existing structure. The sanitary system is proposed to be removed and replaced. The southern deck on the new dwelling is proposed to be located 13' from the NYSDEC regulated tidal wetland boundary, and the new sanitary system is proposed to be located 55' from the tidal wetland boundary. Coverage of the tidal wetland adjacent area by impervious surfaces is proposed to be 19.4%. The purpose of the project is to provide additional living space. The proposed project is located at 24 Stokes Lane in Remsenburg, Town of Southampton in Suffolk County, SCTM# 900-381-01-39 & 77.
