Name of Volunteer: New York State Department of Correctional Services, Division of Facilities Planning and Development, 1220 Washington Avenue, Building 2, Albany, New York 12226

Project Location: The property is located at 247 Harris Road in the hamlet of Bedford Hills, Town of Bedford, Westchester County, New York, Tax Map ID 60.15-2-41. The former firing range comprises an approximately 0.3 acre area on the south side of the 70 acre Bedford Hills Correctional Facility (BHCF). The range is located outside of the facility security fencing and is accessed by an unpaved road that joins the perimeter security road immediately south of the Power House Building. The overall facility is located in a suburban area bounded by Interstate 684 to the east, an undeveloped parcel to the west, Harris Road to the north and an undeveloped parcel to the south. The site is bordered by Broad Brook on the east, which flows north to south, beyond which is a steep wooded hill. A steep wooded hill borders the site to the west.

Project Description: The Remedial Action Work Plan for Remediation of Lead Containing Soil at the Bedford Hills Correctional Facility Firing Range includes the excavation and proper off-site disposal of lead-contaminated soils. Groundwater monitoring will be performed after the soil excavation activities have been completed.

Comment Period: The Voluntary Cleanup Agreement, the Remedial Action Work Plan for Remediation of Lead Containing Soil at the Bedford Hills Correctional Facility Firing Range, and other project-related documents for the site described above are available for review at the locations set forth below. Written comments on the Remedial Action Work Plan must be received within 30 days following the date of this Notice. Written comments expressing objections or opposition to the Work Plan must explain the basis of the opposition and identify the specific grounds which could justify the Department's imposing significant changes to the Work Plan. No formal response is made to comments, but as a result of comments, the Department may reevaluate and revise the Work Plan.

Negative Declaration

Ulster County - The Town of Rosendale Planning Board, as lead agency, has determined that the proposed Dietz Major Subdivision Project will not have a significant adverse environmental impact. The action involves the proposal for a major (4-lot) subdivision for the purpose of constructing several private residential units on an approximately 49 acre site. The project is located at 474 Springtown Road, in the Town of Rosendale, Ulster County New York.

Ulster County - The Town of Rosendale Planning Board, as lead agency, as determined that the proposed Ballincurry Woods Major Subdivision Project will not have a significant adverse environmental impact. The action involves a major (3-lot) subdivision for the purpose of constructing several private residential units on an approximately 6 acre site. The project is located along New York State Route 32 in the Town of Rosendale, Ulster County New York.

Conditioned Negative Declaration

Westchester County - The Town of Greenburgh Town Board, as lead agency, has determined that the proposed Westhab will not have a significant adverse environmental impact provided specific conditions are met. There will be a 30 day public comment period commencing with the date of this notice. The action involves rezoning real property from DS Designed Shopping District and M-22 Multifamily Residence District to M-174 High-Rise Multifamily District to permit the construction of a new three-story "multifamily dwelling" containing approximately twenty-eight (28) dwelling units for "workforce housing." The project is located at 22 Tarrytown Road in White Plains, New York.

The conditions are:

  1. A height limitation of three (3) stories and thirty (30) feet shall be imposed on any building on the property.
  2. Construction shall be in conformance with the zoning requirements of the M-174 District, excluding the height, which shall not exceed the limitation stated in the above condition.
  3. Buildings shall be restricted to a maximum Floor Area Ratio of 0.70.
  4. A vegetative green roof system, of at least 6,000 square feet shall be installed and maintained to mitigate stormwater impacts.
  5. Marketing of units shall be restricted to "workforce housing."
  6. Utilization of traffic control devices as specified in the conditioned negative declaration, unless modified by the Planning Board, shall be installed.

Positive Declaration and Public Scoping

Dutchess County - The Town Board of the Town of Poughkeepsie, as lead agency, has determined that the proposed Hudson Heritage Park, LLC Development Master Plan may have a significant adverse impact on the environment and a Draft Environmental Impact Statement must be prepared. Written comments on the draft scope will be accepted until November 28, 2008. A public scoping session will be held October 22, 2008 at 7:00 p.m. at Town Hall, One Overocker Road, Poughkeepsie, NY 12603. The action involves the development of a mixed use pedestrian-oriented residential and commercial development on an approximately 156 acre site. Under the proposed full build-out the project would include 750 single-family, townhouse, and multifamily residential units, and approximately 100,000 square feet of office space, and 250,000 square feet of retail space. The Project would also preserve the approximately 18 acre "Great Lawn" as a centerpiece for the overall development, and would preserve for adaptive reuse the remaining portion of the National Landmark Building consisting of ± 269,099 square feet The project is located on Hudson View Drive, Poughkeepsie, New York - Former Poughkeepsie Psychiatric Center site located on Route 9 opposite Marist College.

Notice of Completion of Final EIS and Public Hearing

Westchester County - The Town of Greenburgh Planning Board, as lead agency, has accepted a Final Environmental Impact Statement on the proposed Toll Brothers, Inc.: The Gel-Sprain Realty Property Subdivision. A Town of Greenburgh Planning Board public hearing on the Final EIS will be held at 8:00 p.m. on Wednesday, November 5, 2008 at Greenburgh Town Hall, 177 Hillside Avenue, Greenburgh, NY. The FEIS is also available at the following website: http://www.greenburghny.com. The action involves the development of twenty-four (24) single family residential lots. The proposed project would also include approximately 16.86 acres as permanent open space. The project would occupy an approximately 41.9 acre site on the southern side of Ardsley Road, between Sprain Road and the Sprain Brook Parkway, in the Town of Greenburgh, Westchester County.
