Project Description:

The Department has received an application to modify the Title V Facility Permit originally issued March 10, 1999 and renewed September 11, 2006, for the American Packaging Corporation - Rochester Facility, which manufactures specialty printed paper and plastic film packaging for the food industry. The facility meets the definition of a major facility in 6 NYCRR Part 201-2.1(b)(21), and is subject to Part 201-6 (Title V) regulations due to current potential facility emissions of volatile organic compounds (VOC) of over 250 tons per year.

Current facility operations include extrusion, ozone treatment, and printing operations in Emission Unit A-00001, and flexographic and rotogravure packaging printing and coating operations using solvent based and water based inks in Emission Unit A-00002.

The proposed modification is a facility expansion to add a new extrusion laminating and coating line, with ozone substrate treatment, in a new Emission Unit A-00003. As part of this application, American Packaging has proposed to limit potential VOC emissions from the new Emission Unit to 35 tons per year, below the 40 ton per year VOC emission increase threshold in 6 NYCRR Part 231-2 New Source Review in Ozone Transport Regions regulations.

In response to the application, the Department has generated a Draft Modified Title V Facility Permit for review and has made a tentative determination to issue a Modified Title V Permit. The application, Draft Permit, RACT Evaluation, and Permit Review Report are available for review at the Region 8 NYSDEC office. According to the terms of a Consent Order, the Draft Permit maintains a 200 ton per year VOC emission limit for Emission Unit A-00001 and a Part 228 and Part 234 VOC RACT variance limit for a solvent based ink printing and coating process in Emission Unit A00002, restricting VOC emissions from that process to 57.4 tons per year.

In accordance with 6NYCRR Parts 621.7(b)(9) and 201-6.4(c), the Administrator of the United States Environmental Protection Agency (USEPA) has the authority to bar issuance of any Title V Facility Permit if it is determined not to be in compliance with applicable requirements of the Clean Air Act or 6NYCRR Part 201.
Persons wishing to inspect the subject Title V files, including the application with all relevant supporting materials, the draft permit, and all other materials available to the DEC (the "permitting authority") that are relevant to this permitting decision should contact the DEC representative listed below.

DEC will evaluate the application and the comments received on it to determine whether to hold a public hearing. Comments and requests for a public hearing should be in writing and addressed to the Department representative listed below. Materials will be not be mined from below the water table On-site processing will include screening at a rate not to exceed 150 tons per hour. Part of the area has been previously used for mining. Reclamation will be concurrent with mining operations and will include reclamation to grasses and restoration to useable forage area and wildlife habitat.
