Project Description:

The applicant proposes to open and operate a surface consolidated quarry to extract sandstone for decorative purposes and to provide crushed aggregate for construction. Access is via Beaver Meadow Road, approximately 1.9 miles south of Old Military Turnpike and Plank Road intersection, with the site located 1.8 miles west of Plank Road. The proposed 41.5 acre quarry is part of a 944 acre parcel owned by the applicant. Operations will include drilling, blasting, excavating, and onsite crushing and screening using portable processing equipment. The site will be mined in three phases and has a projected life of 40 years. Reclamation will occur as mining progresses. Final reclamation will occur within two years of termination of all mining activity and will consist of grading the quarry perimeters; establishing vegetation, including grasses and native plants, shrubs and trees on 33 acres; establishing a 6.5 acre surface water pond; and retaining a 1 acre bedrock outcrop. The project also requires minor improvements to Beaver Meadow Road, including replacement of existing culverts carrying Graves Brook under Beaver Meadow Road and Plank Road.
The project also requires a permit from the Adirondack Park Agency, APA Project No. 2005-300.

State Environmental Quality Review (SEQR) Determination:

Cultural resource lists and map have been checked. No registered, eligible or inventoried archaeological sites or historic structures were identified at the project location. No further review in accordance with SHPA is required.

Coastal Management:

This project is not located in a Coastal Management area and is not subject to the Waterfront Revitalization and Coastal Resources Act.

Project Description:

The Department (DEC) has prepared a draft permit and made a tentative determination to issue a modification to the existing Air Title V Facility permit for the Momentive Performance Materials facility. This modification makes revisions to the Miscellaneous Organic NESHAP (National Emission Standards for Hazardous Air Pollutants) and MACT (Maximum Achievable Control Technology) requirements as requested in the facility's "Pre-Compliance Report" submitted November 1, 2007; corrects three errors in automatic waste feed cut-off limits in the original renewal; and replaces the burners on two hot oil furnaces.

In accordance with 6NYCRR Parts 621.7(b)(9) and 201-6.4(c), the Administrator of the United States Environmental Protection Agency (USEPA) has the authority to bar issuance of any Title V Facility Permit if it is determined not to be in compliance with applicable requirements of the Clean Air Act or 6NYCRR Part 201.

Persons wishing to inspect the subject Title V files, including the application with all relevant supporting materials, the draft permit, and all other materials available to the DEC (the "permitting authority") that are relevant to this permitting decision should contact the DEC representative listed below. The Draft Permit and Permit Review Report may be viewed and printed from the Department web site at: http://www.dec.ny.gov/chemical/32249.html.

DEC will evaluate the application and the comments received on it to determine whether to hold a public hearing. Comments and requests for a public hearing should be in writing and addressed to the DEC contact listed below.
