Project Description:

The Department has prepared draft permits and has made a tentative determination to approve the application to renew the facility's Title IV and Title V permits for 5 more years, modify the Title V permit, and approve emission reduction credits (ERC's. The Title V modification consists of incorporating permit conditions for operation of the GE LM-6000 combustion turbine which is currently operating under a State Facility Permit (ID: 1-2820-00358/00006). The ERC's are for past emission reductions of 72.5 tons of oxides of nitrogen (NOx), and 2.3 tons of volatile organic compounds (VOC's), which were the result of decommissioning two (2) diesel engines (emission units U-00001 and U-00002) previously operated at the Freeport facility. The facility currently consists of one GE LM-6000 combustion turbine, and one Curtis Wright "black start-up" combustion turbine.

In accordance with 6NYCRR Parts 621.7(b)(9) and 201-6.4(c), the Administrator of the United States Environmental Protection Agency (USEPA) has the authority to bar issuance of any Title V Facility Permit if it is determined not to be in compliance with applicable requirements of the Clean Air Act or 6NYCRR Part 201.

The Department has prepared draft permits, and has made a tentative determination to approve the application to renew the facility's Title IV permit and to receive a Title V permit. In 2003 the facility received a State Facility air pollution control permit allowing the construction and operation of the subject facility. Pursuant to Sections 201-6.1(a)(4) and 201-6.3(a)(2) of Title 6 of the New York Codes, Rules and Regulations ("NYCRR"), Equus Power 1, LP is required to apply to DEC for a federal operating permit under Title V of the CAA within one year of commencing commercial operation of the facility.

The facility consists of one GE LM 6000 simple cycle combustion turbine with ancillary support equipment. The turbine will utilize natural gas as the primary fuel with low-sulfur (0.05%) distillate fuel for backup.

In accordance with 6NYCRR Parts 621.7(b)(9) and 201-6.4(c), the Administrator of the United States Environmental Protection Agency (USEPA) has the authority to bar issuance of any Title V Facility Permit if it is determined not to be in compliance with applicable requirements of the Clean Air Act or 6NYCRR Part 201.

State Environmental Quality Review (SEQR) Determination:

Project is not subject to SEQR because it is a Type II action.

SEQR Lead Agency: None Designated

State Historic Preservation Act (SHPA) Determination:

The proposed activity is not subject to review in accordance with SHPA. The permit type is exempt or the activity is being reviewed in accordance with federal historic preservation regulations.

Coastal Management:

This project is located in a Coastal Management area and is subject to the Waterfront Revitalization and Coastal Resources Act.

Opportunity for Public Comment:

Comments on this project must be submitted in writing to the Contact Person no later than Nov 07, 2008.
