Project Description:

Notice of Complete Application, Notice of Availability of Draft Permit, and Notice of Public Comment Period
The New York State Department of Environmental Conservation (DEC) intends to issue a Hazardous Waste Management permit renewal to Ciba Corporation and Hercules Incorporated for the Main Plant site located near Glens Falls. The permit being renewed is an existing 6NYCRR Part 373 permit which addresses the post-closure care of the hazardous waste land disposal unit and operations and maintenance of the remedies selected for other areas on-site.
State regulations require that the public be given 45 days to comment on the draft permit renewal. The public comment period begins the week of September 29, 2008 and ends on November 17, 2008.

Facility Description
The Main Plant site is located in the Town of Queensbury, just east of the City of Glens Falls in Warren County. In 1989, production at the site was stopped and the majority of the buildings were demolished. Under the supervision of DEC, site investigation and remediation activities were initiated. Construction of the final corrective measures began in May 2000, and was completed in August 2004. In 2006, DEC accepted the Corrective Measures Implementation - Construction Documentation Report. Since that time, the site has continued to operate and maintain the completed corrective measures.

The Part 373 Post-Closure permit renewal allows Ciba/Hercules to continue to operate and maintain the existing corrective measures. For the Main Plant site, the corrective measure is a soil cover with downgradient groundwater interception for all on-site areas except the Corrective Action Management Unit (CAMU). The CAMU has been closed as a land disposal unit by capping it with a low permeability cap (also known as a RCRA cap). Deed restrictions will be imposed to limit future use of the site. A program of groundwater monitoring has been initiated and deed restrictions will be placed on the use of groundwater. Other site work, such as mowing, fencing repairs, roadway and utility maintenance are also covered by this permit.

Tentative Determination
The Department has made a tentative determination to renew the existing Part 373 permit for post-closure care of a closed hazardous waste disposal facility and has prepared a Draft Permit pursuant to the regulations in 6NYCRR Part 373-2 (Final Status Standards for Owners and Operators of Hazardous Waste Treatment, Storage and Disposal Facilities), as well as with all other applicable hazardous waste management laws and regulations.

How to Provide Your Comments
All comments will be considered in making the final decision about issuance of the permit renewal. A response to any comments submitted will be issued to identify any changes from the draft version of these documents, and will describe and respond to the issues raised. A notice of the decision will be sent to each person who submits written comments or who requests such notice.

In-lieu of, or in addition to the submission of comments, interested persons may request a public hearing. Any request for a public hearing must be in writing, stating the nature of the issues proposed to be raised in the hearing.

State Environmental Quality Review (SEQR) Determination:

Project is not subject to SEQR because it is a Type II action.

SEQR Lead Agency: None Designated

State Historic Preservation Act (SHPA) Determination:

The proposed activity is not subject to review in accordance with SHPA. The permit type is exempt or the activity is being reviewed in accordance with federal historic preservation regulations.

Coastal Management:

This project is not located in a Coastal Management area and is not subject to the Waterfront Revitalization and Coastal Resources Act.

Opportunity for Public Comment:

Proposed construction of a 2886 square foot office building and 10 vehicle parking lot in the adjacent area of Freshwater Wetland GF-19 (Class II). The building and parking lot would be located about 30 feet from the wetland boundary. The project is located on the west side of Meadowbrook Road, 300 feet north of Quaker Road, Town of Queensbury.

Project is an Unlisted Action and will not have a significant impact on the environment. A Negative Declaration is on file. A coordinated review was performed.

State Historic Preservation Act (SHPA) Determination:

Cultural resource lists and map have been checked. No registered, eligible or inventoried archaeological sites or historic structures were identified at the project location. No further review in accordance with SHPA is required.

Coastal Management:

This project is not located in a Coastal Management area and is not subject to the Waterfront Revitalization and Coastal Resources Act.

Opportunity for Public Comment:
