Project Description:

The Department has prepared a Draft Permit and has made a tentative determination to issue a Department Initiated Modification (DIM) to the existing Title V Air Facility Permit for Norlite Corporation (Norlite). Norlite operates two rotary kilns to manufacture light weight aggregate from shale. In these kilns, Norlite burns hazardous wastes/low grade fuel (LGF) and waste oil for heat. Norlite is located at 628 South Saratoga Street (State Route 32) in the City of Cohoes, Albany County New York.

In accordance with 6NYCRR Parts 621.7(b)(9) and 201-6.4(c), the Administrator of the United States Environmental Protection Agency (USEPA) has the authority to bar issuance of any Title V Facility Permit if it is determined not to be in compliance with the applicable requirements of the Clean Air Act or 6NYCRR Part 201.

Persons wishing to inspect the subject Title V files, including the application with all relevant supporting materials, the Draft Permit, and all other materials available to the DEC (the "permitting authority") that are relevant to this permitting decision should contact the DEC representative listed below. The Draft Permit and Permit Review Report may be viewed and printed from the Department web site at: http://www.dec.ny.gov/chemical/32249.html.

DEC will evaluate the application and the comments received on it to determine whether to hold a public hearing. Comments and requests for a public hearing should be in writing and addressed to the Department representative listed below. The applicant proposes to develop a 24 lot residential subdivision, to be known as Country Ridge Estates, on a 20 +/- acre site, located in the Town of Amsterdam, at the ends of North and South Country Ridge Drive, being just easterly of Upper Van Dyke Avenue. The proposal consists of clearing and grading for lot development, construction of new paved roadways; installation of public utilities, and installation of a stormwater management system. A total of 0.08 +/- acres of federal wetlands identified within the project boundaries will be permanently filled and fill/culverting of approximately 102 linear feet of intermittent stream channel will occur as a result of grading associated with the construction of roadways and lot development.

Project Description:

The New York State Department of Environmental Conservation (NYSDEC) is pursuing a Department Initiated Modification (DIM) to the State Pollutant Discharge Elimination System (SPDES) Permit (NY 003 1151, DEC Identification #: 4-3646-00016/00001), the Oneonta Wastewater Treatment Plant pursuant to 6 NYCRR Part 750-1.18, New York State's Environmental Benefit Permit Strategy (EBPS).

The changes to the permit are as follows:

WQBELs for Zinc , Copper, and Phosphorous have been added to the permit. The limit for Mercury may be required based on the additional data submitted after six months from the effective date of permit modification. WQBELs for UOD and Nitrogen, Total have also been added.

The modification also includes several other minor reporting modifications. The Oneonta Wastewater Treatment Plant has surface discharge into the Susquehanna River, a class B water. Additional information including the current permit, renewal applications, and supporting documentation may be obtained from or inspected at the DEC central office in Albany. Substantive comments on the permit or requests for hearing or both must be submitted in writing to the contact person. DEC seeks comments on the proposed regulated activity prior to making a final decision on permit issuance.
