Project Description:

The applicant proposes to construct 39 linear feet of new bulkhead 24" seaward of an existing bulkhead, 18" higher than the original. Returns are proposed to be constructed on both ends of the bulkhead. The applicant proposes to dredge to 4' below mean low water no greater than 10' off shore of the replacement bulkhead with the resultant 25 cu. yds. of dredged material to be placed as backfill. NYSDEC-regulated tidal wetlands exist at the site. The purpose of the project is to provide shoreline stabilization. The proposed project is located at 2766 Riverside Drive in Wantagh, Town of Hempstead in Nassau County, NCTM# 63-291-33.

The Department has prepared a Draft Permit and has made a tentative determination to approve this application to the applicant's existing facility located at 242 Rabro Dr., Hauppauge, Suffolk County for an Air State Facility permit pursuant to Article 19 (Air Pollution Control) of the Environmental Conservation Law (ECL). The facility operates a hot mix asphalt plant. The proposed State Facility Permit caps NOx emissions at the facility to 5 tons per year and CO to 80 tons per year. When issued the Draft Permit will supersede the existing air facility registration, which was issued in 1999. The facility has agreed to accept permit conditions that will limit the production of asphalt to no more than 400,000 tons per year. By accepting these state and federally enforceable limits the facility will not be subject to the provisions of the Title V operating permit program. The application, draft permit, relevant supporting materials and regulations are available for review during normal business hours at the DEC office provided in this notice. Comments of support or objection may be made by filing a written statement by the deadline indicated. DEC may schedule a public hearing based upon an evaluation of the nature and scope of any written objections raised. Hearing notices will contain instructions on filing for party status and submitting comments.

The facility has agreed to accept permit conditions that will limit the production of asphalt to no more than 350,000 tons per year. By accepting these state and federally enforceable limits the facility will not be subject to the provisions of the Title V operating permit program. Project Description:

The applicant proposes to remove existing rip-rap and construct 120 linear feet of bulkhead along the shoreline of a residential property. The area landward of the bulkhead is proposed to be filled with 100 cu. yds. of clean fill from an upland source. Approximately 95 linear feet of the bulkhead and all of the fill is proposed to be located seaward of the apparent high water line in NYSDEC regulated tidal wetlands associated with Moriches Bay. The purpose of the project is stabilize the shoreline. The proposed project is located at 22 Stokes Lane in Remsenberg, Town of Southampton in Suffolk County, SCTM# 900-381-01-037.
