Negative Declaration

Dutchess County - The Town Board of the Town of Red Hook, as lead agency, has determined that the proposed Red Hook Communications Facility will not have a significant adverse environmental impact. The action involves the colocation of the Town of Red Hook water tank and communications facility. The colocation will consist of a tower extension of 10 feet to make the monopole 160 feet tall, a six panel antenna mounted on the existing monopole at a height of 160 feet, a GPS unit, equipment cabinets placed in a 18 foot by 20 foot lease area within the existing compound and all related ground equipment and utility services (power and telephone). The project is located at 113 Kelly Road in the Town of Red Hook, New York.

Orange County - The Town Board of the Town of Newburgh, as lead agency, has determined that the proposed Town of Newburgh Local Law Amending Zoning Law and Map to Establish LHI Overlay District will not have a significant adverse environmental impact. The action involves the adoption of a local law adding a Light and Heavy Equipment and Recreational Vehicle Sales, Service and Repair LHI Overlay Zoning District to the Zoning Code and Zoning Map of the Town of Newburgh. The LHI District will be an overlay with boundaries that conform to and are contiguous with the B Business zoning district boundaries along the Route 9W corridor in the Town. In the LHI overlay district, light and heavy industrial equipment and recreational vehicle sales, service and repair uses will be permitted subject to minimum bulk requirements, certain additional regulations, site plan and architectural review by the Planning Board. This overlay district will provide clarity as to where these uses are permitted and under what conditions, particularly access, setbacks and landscaping. The project is located along the Route 9W corridor in the Town of Newburgh, New York.

Orange County - The Town of Wallkill, as lead agency, has determined that the proposed Sale of the Town of Wallkill's Echo Lake Property will not have a significant adverse environmental impact. The action involves the sale of the Echo Lake property and the Town of Wallkill's acquisition of two limited access easements from Orange County and the purchaser. The project is located on Echo Lake Road in the Town of Wallkill, New York.

Sullivan and Ulster Counties - The New York State Department of Environmental Conservation (NYS DEC), as lead agency, has determined that the proposed Adoption of the Catskill Park State Land Master Plan Revision will not have a significant adverse environmental impact. The action involves the adoption of management guidelines for all state lands administered by NYS DEC within the Catskill Park, as well as parcels of Forest Preserve land situated within the counties of Ulster, Greene, Delaware and Sullivan, but outside the Catskill Park boundaries. The plan was approved and signed by the Commissioner on August 27th 2008. The revised Catskill Park State Land Master Plan designates management units and directs the Department to develop individual unit management plans that guide management activities and public use of those units. The plan includes the creation of a new land classification, Primitive Bicycle Corridor in Wilderness Areas and designates four Bicycle Corridors in the park. It allows for bicycle use in Wild Forests on roads open to the public, state truck trails, old wood roads, foot trails, snowmobile trails, and horse trails, unless such use is deemed unsuitable through the UMP process. The revision also allows for management of invasive species. The Catskill Park State Land Master Plan (CPSLMP) applies to all state lands administered by NYS DEC within the Catskill Park, as well as parcels of Forest Preserve land situated within the counties of Ulster, Greene, Delaware and Sullivan, but outside the Catskill Park boundaries.

Westchester County - The Town of North Salem, as lead agency, has determined that the proposed Adoption of Amendments to Chapter 250 "Zoning" will not have a significant adverse environmental impact. The action involves the rezoning of three tax parcels totaling approximately 17.895 acres from Contractor's Business (CB) to Medium Density Residential (R-1) and make certain modifications to Local Law No. 5 of 2007. Modifications to Local Law No. 5 of 2007 would recognize the existing Clearwater Excavating use as a Conditional Use within the R-1 Zoning District subject to specific criteria. The project is located on the north side of Hardscrabble Road and east of I-684 in the Town of North Salem, New York.

Positive Declaration and Public Scoping

Westchester County - The Town of Cortlandt Planning Board, as lead agency, has determined that the proposed Deco Landing Holding Corporation may have a significant adverse impact on the environment and a Draft Environmental Impact Statement must be prepared. A public scoping session will be held on November 5, 2008 at 8:00 p.m. at the Cortlandt Town Hall, 1 Heady Street, Cortlandt Manor, New York. The action involves the application of Deco Land Holding Corp. for Site Development Plan Approval and for Steep Slope, Wetland and Tree Removal Permits for the construction of 4 recreational fields and associated parking facilities and rock removal, crushing, processing and trucking from the site on a 12.3 acre parcel. The project is located on the west side of Route 9, across the intersection with Roa Hook Road in the Town of Cortlandt, New York
