Project Description:

This Department has received a request to modify an Article 19 of Environmental Conservation Law (Air Pollution Control) Air State Facility Permit for the Remington Arms Company located at 14 Hoefler Ave, Ilion, NY 13357.

The Department has made a tentative determination to approve the application for permit modification. The modification to the permit allows the operation of emission unit WOODF which incorporates the operation of wood machining, sanding and finishing, to the current operations, which primarily includes the manufacture of small firearms and components thereof. A secondary operation is the manufacture of commercial products through the application of powdered metal technology. The facility has capped out of Title V Permitting requirements by tracking and restricting it's emissions of Hazardous Air Pollutants below individual emissions of 10 tons per year and cumulative emissions of 25 tons.

State Environmental Quality Review (SEQR) Determination:

Project is an Unlisted Action and will not have a significant impact on the environment. A Negative Declaration is on file. A coordinated review was not performed.

SEQR Lead Agency: None Designated

State Historic Preservation Act (SHPA) Determination:

Cultural resource lists and map have been checked. No registered, eligible or inventoried archaeological sites or historic structures were identified at the project location. No further review in accordance with SHPA is required.

Coastal Management:

This project is not located in a Coastal Management area and is not subject to the Waterfront Revitalization and Coastal Resources Act.

Opportunity for Public Comment:

Comments on this project must be submitted in writing to the Contact Person no later than Oct 10, 2008.

Project Description:

The applicant, Niagara Mohawk Power Corporation has applied for a US Army Corps of Engineers Nationwide Permit #38 and a 401 Water Quality Certification to cover impacts to a 13 acre wetland at the Harbor Point Hazardous Waste Remediation Site. This remedial action is required under a NYSDEC Order on Consent #A4-0473-0000 and NYSDEC Record of Decision. The disturbance consist of removal of 26,500 cubic yards of buried waste from the wetland. This is not a DEC mapped freshwater wetland.

The proposed activity is not subject to review in accordance with SHPA. The permit type is exempt or the activity is being reviewed in accordance with federal historic preservation regulations.

This project is not located in a Coastal Management area and is not subject to the Waterfront Revitalization and Coastal Resources Act.
