Project Description:

The New York State Department of Environmental Conservation (DEC) has determined to modify the City of Poughkeepsie's State Pollutant Discharge Elimination System (SPDES) permit, number NY0026255, in accordance with New York State regulations at 6NYCRR Part 750-1.18(b)(5) & (6).

The following modifications were made to the permit: The national combined sewer overflow (CSO) policy requires that the CSO policy be implemented in SPDES permits.The permittee has completed the Phase I requirements of a CSO Long-Term Control Plan LTCP) and has proposed a schedule for construction of sewer separation projects to meet the Phase II requirements of the LTCP. This schedule was approved by DEC. The draft permit has incorporated the schedule of construction in accordance with a condition of the existing permit. The compliance schedule for monitoring of Bis (2-Ethylhexyl) Phthalate and other CSO best management practice reports were removed from permit as they has been completed.

The pretreatment program language was updated to reflect amendments to 40CFR Part 403.

The toxicity testing requirement was removed as it was completed and no toxicity was found in the effluent.

The regional water engineer's address was updated.

The applicant proposes to clear-cut two areas within NYS-regulated Freshwater Wetland MB-18, Class 1, to create open, non-woody wetland suitable as habitat for Bog Turtle, Glyptemys muhlenbergii. One area, 0.35 acre in size, is being cleared of the invasive species Common Reed, Phragmites australis; the second area, 1.25 acres in size, is currently woody vegetation. Following cutting, the cut stems will be hand-treated with the pesticide glyphosate. All work is to be done with hand tools and no mechanized vehicles are proposed for use in the wetland.

Project Description:

The State Pollutant Discharge Elimination System (SPDES) Permit for the Orange County Department of Environmental Facilities & Services has been modified as a department initiated modification in response to the United States Environmental Protection Agency's (USEPA's) approval of the Orange County Sewer District's Industrial Pretreatment Program. In accordance with 40 CFR 403.8(a), federal regulations require municipal wastewater treatment facilities with design flows greater than 5.0 MGD that receive pollutants from industrial users to develop and implement an industrial pretreatment program. A June 4, 2004 SPDES permit modification was issued for an expansion of the wastewater treament plant from a design flow of 4.5 MGD to 6.0 MGD. As part of that permit modification, the Orange County Department of Environmental Facilities & Services was required to develop and submit an industrial pretreatment program report to the USEPA for review and approval. The industrial pretreatment program report was tentatively approved by EPA on August 14, 2007; was public noticed on November 2, 2007; and received final approval from the USEPA on July 8, 2008. Upon final approval, the USEPA requested modification of the SPDES permit to reflect the approval of the industrial pretreatment program. As such, this draft permit has been modified from the existing SPDES Permit in the following ways:

The existing permit pages describing the Pretreatment Program Development and Implementation Requirements have been updated to reflect the current permit language for Pretreatment Program Implementation Requirements and references the July 8, 2008 approval date.

Additional Permit Revisions - As part of this department initiated modification, the permit has also been updated as follows:

Monitoring for total phosphorus has been added for discharge outfalls 001 & 002. Monthly monitoring results will be reported as both concentration and mass discharge values. Upon review of the phosphorus data, the Department may reopen the permit to include a limitation for phosphorus.

The Schedule of Compliance items that were listed on page 12 of 16 of the existing permit have been removed as these actions have been satisfactorily completed.

The address and telephone number for Region 3 Office has been updated to reflect current information.

The applicant operates an existing 3.1 acre shale mine located on the west side of Sawkill Road, approximately one mile south of the NYS Route 209 overpass. Currently no processing is authorized at the site and the approved final reclamation land-use objective is a parking lot. The applicant proposes to process material on-site using a portable dry screen with a capacity of up to 165 tons per hour; conduct blasting 1-2 times per year to loosen shale that cannot be obtained with an excavator; and provide an on-site temporary storage area within the mine for materials related to ongoing excavating business jobs. Finally, the final land use objective proposed after mining is now a storage yard for large equipment and excavators. No changes to the depths or areal limits of mining are proposed.
