Project Description:

The New York State Department of Environmental Conservation (NYSDEC) is pursuing a Department Initiated Modification (DIM) to the State Pollutant Discharge Elimination System (SPDES) Permit (NY 021 3934), DEC Identification #7-0322-00001/00001, The Town of Birthstone pursuant to 6 NACRE Part 750-1.18, New York State's Environmental Benefit Permit Strategy (EBONY). The most significant proposed changes to the permit are as follows: (1). Discharge Monitoring Reports are now required to be submitted to the Department on a quarterly basis; (2). Stream class has been updated from class D to class C; (3). A water quality based limit for ammonia of 1.5 mg/l has been added. Previous limit was 2 mg/l; (4). A water quality based limit for chlorine residual of 0.1 mg/l has been added. Previously, the permit specified a range of 0.5 to 2 mg/l; (5). Contact information and addresses have been updated.

Availability of Application Documents:

Filed application documents, and Department draft permits where applicable, are available for inspection during normal business hours at the address of the contact person. To ensure timely service at the time of inspection, it is recommended that an appointment be made with the contact person.

State Environmental Quality Review (SEQR) Determination:

Project is an Unlisted Action and will not have a significant impact on the environment. A Negative Declaration is on file. A coordinated review was performed.

State Historic Preservation Act (SHPA) Determination:

The proposed activity is not subject to review in accordance with SHPA. The permit type is exempt or the activity is being reviewed in accordance with federal historic preservation regulations.

Project Description:

The New York State Department of Environmental Conservation (NYSDEC) is pursuing a Department Initiated Modification (DIM) and renewal to the State Pollutant Discharge Elimination System (SPDES) Permit (NY 002-2730, DEC Identification #: 7-4930-00026/00001), the Town of Owego Sewer District #1 Facility pursuant to 6 NYCRR Part 750-1.18, New York State's Environmental Benefit Permit Strategy (EBPS). The changes to the permit are as follows:

Action levels for Total Nitrogen and Total Phosphorus have been added. A Schedule of Compliance has been included requiring the permittee to improve nutrient removal at the facility. A short term, high-intensity monitoring program has been implemented for Mercury within the Schedule of Compliance. A permit page to account for the Emergency Overflows has been added. The action level for tin has been removed since it has only been detected once during three years of monitoring and there is no water quality standard for tin. An action level of 0.1 mg/L has been implemented for Zinc.

The modification also includes several other minor reporting modifications.

The Town of Owego Sewer District #1 Facility has surface discharge into the Susquehanna River, a class B water.

Additional information including the current permit, renewal applications, and supporting documentation may be obtained from or inspected at the DEC central office in Albany. Substantive comments on the permit or requests for hearing or both must be submitted in writing to the contact person. DEC seeks comments on the proposed regulated activity prior to making a final decision on permit issuance.
