The department has made a tentative determination to approve the request for a permit modification to SPDES permit NY 0258229. Two outfalls would be added to the permit, the first, a surface discharge from an oil/water separator to Canacadea Creek which has a Class C and Standard of C(TS). The second discharge is sanitary wastewater to a septic tank/sand filter with a design flow of 300 gallons per day. The department is seeking comments on the proposed regulated activity prior to making a final decision on permit issuance. As such, this tentative determination does not signify department approval for or endorsement of the activity for which a permit is sought.

The Department of Environmental Conservation (DEC) has received an application to renew State Pollutant Discharge Elimination System (SPDES) # NY 016 9943, for The Original Dog Bar Hotel in Erie County. This is a pre-existing Private/Commercial/Institutional SPDES permit. DEC has made a tentative determination to renew this permit and set a standard five year term maintaining current effluent limitations and monitoring and reporting requirements. This permit involves the surface discharge of up to 1,500 gallons per day of treated sanitary waste into Cazenovia Creek-W. Branch via storm sewer, a class B water.

Additional information including the current permit, renewal applications, and supporting documentation may be obtained from or inspected at the DEC central office in Albany. Substantive comments on the permit or requests for hearing or both must be submitted in writing to the contact person.

Project Description:

Construction of an approximately 110 foot by 175 foot brine well drilling pad extending approximately 30 feet into the regulated 100 foot wide adjacent area of the Dale Road (DA-2) Wetland. The well drilling pad is proposed to be constructed with mixed gravel and clay substrate topped with crushed rock. The pad is anticipated to disturb 5,250 square feet of the wetland adjacent area of which 3,500 square feet will be temporarily disturbed, and later restored. The DA-2 Wetland is a class II wetland.
