Negative Declaration

Orange County - The Town of Wawayanda Planning Board, as lead agency, has determined that the proposed Simon 8 Lot Commercial Subdivision will not have a significant adverse environmental impact. The action involves a proposed 8 lot commercial subdivision of an existing 67.6 ± acre parcel of property. The proposed commercial lots range in size from a minimum of 2 acres to a balance parcel of 52.62 acres. The project involves the construction of a 1,100 ± foot access road, the installation of water and sewer utilities and stormwater management collection and treatment systems. All lots are proposed to be serviced by municipal water and sewer. Traffic studies, stormwater management studies and archaeological resource evaluations were performed in support of the project. The project is located on the south side of Dolsontown Road, approximately 2,000 feet east of the intersection with NYS Route 17M in the Town of Wawayanda, New York.

Orange County - The Town Board of the Town of Newburgh, as lead agency, has determined that the proposed Delaware Aqueduct Tap Water Filtration Plant - DWSRF 17566 will not have a significant adverse environmental impact. The action involves the construction of a water filtration plant to treat the Town of Newburgh Delaware Aqueduct supply to meet the USEPA Surface Water Treatment Rule. The project is located on Lattintown Road in the Town of Newburgh, New York.

Westchester County - The Town of Greenburgh Planning Board, as lead agency, has determined that the proposed Cingular Steep Slopes will not have a significant adverse environmental impact. The action involves the construction of an 80 foot tall flag pole and related equipment at grade. Portions of the project will disturb slopes in excess of 25% triggering a local Type I action. The project is located at 901 Central Park Avenue, Town of Greenburgh, New York.

Notice of Acceptance of Draft EIS and Public Hearing

Orange County - The Planning Board of the Town of Deerpark, as lead agency, has accepted a Draft Environmental Impact Statement on the proposed Basherkill Subdivision. A public hearing on the Draft EIS will be held on September 10, 2008 at 7:00 p.m. at the Town of Deerpark Town Hall, Route 209, Huguenot, Town of Deerpark, New York. Written comments on the Draft EIS will be accepted by the contact listed below until October 31, 2008. A copy of the Draft EIS is on file in the Office of the Building Department, Town Hall, Route 209, Hugenot, NY for inspection and review and it can also be viewed at: www.basherkillsubdivision.com.

The action involves the development of 689 acres in the RR and HMU Zones to construct 354 residential housing units and a commercial/retail component. The project will be served by private, on-site community water and sewage disposal systems, including several wells and a surface discharge wastewater treatment facility. The project is located on Route 211 between Route 62 and Port Orange Road in the Town of Deerpark, New York.

Putnam County - The Town Board of the Town of Kent, as lead agency, has accepted a Draft Generic Environmental Impact Statement on the proposed Adoption of the proposed Kent Comprehensive Plan. A public hearing on the Draft GEIS will be held on September 10, 2008 at 7:00 p.m. at the Town Hall, Town of Kent, 25 Sybil's Crossing, Kent Lakes, NY 10512. Written comments on the Draft GEIS will be accepted until September 22, 2008. The action involves the proposed adoption of the Kent Comprehensive Plan pursuant to Article 16, §272-a of the Town Law. The Kent Comprehensive Plan would replace the 1990 Kent Comprehensive Plan. The project is located town wide in the Town of Kent, New York.
