Project Description:

The applicant proposes to install a new marina and large-vessel dock on the east shore of the Hudson River to be known as Shadows Marina. The proposed facility would be located off Rinaldi Drive in the City of Poughkeepsie. The marina is proposed to consist of 99 permanent slips and up to 12 transient slips within a network of cable-achored, floating docks surrounded by a floating wave attenuator. The cables are proposed to be anchored to the river bottom by about 130 concrete blocks, each weighing 5,000 pounds, placed on the river bottom. The perimeter of the marina would extend into the river approximately 250-300 feet and along the shoreline for a distance of approximately 750 feet. A sanitary pumpout will also be installed on a 10 x10 foot float. In addition, a large-vessel berthing dock is proposed that would consist of a 40 x 20 foot float attached to the shore by a 4 x 28 foot gangway, and two berthing dolphins spaced 50 feet apart. The dolphin piles will be drilled into the ledge rock in the river bottom to a depth of 5 feet. The berthing area would be located about 1,000 feet south of the proposed marina and is designed to accomodate a vessel up to 200 feet in length. The project is associated with the upland development of the site as a mixed-used water front site.

The applicant has also applied for a Freshwater Wetlands permit to construct a permanent, buried waterline connecting the two wells to the Condominium's existing water supply system. The construction would disturb approximately 400 linear feet of the adjacent area of Wetland #L-36 (Class I) in order to install three parallel 2-inch diameter water mains. The wetland itself will not be disturbed by this construction. The wells, wetland and the Condominium are all located on NYS Rt 35 in the hamlet of Cross River, Town of Lewisboro, Westchester County NY.

Availability of Application Documents:

Filed application documents, and Department draft permits where applicable, are available for inspection during normal business hours at the address of the contact person. To ensure timely service at the time of inspection, it is recommended that an appointment be made with the contact person.

State Environmental Quality Review (SEQR) Determination:

Project is an Unlisted Action and will not have a significant impact on the environment. A Negative Declaration is on file. A coordinated review was not performed.

SEQR Lead Agency: None Designated

State Historic Preservation Act (SHPA) Determination:

Cultural resource lists and map have been checked. No registered, eligible or inventoried archaeological sites or historic structures were identified at the project location. No further review in accordance with SHPA is required.

Coastal Management:

This project is not located in a Coastal Management area and is not subject to the Waterfront Revitalization and Coastal Resources Act.

Opportunity for Public Comment:

Comments on this project must be submitted in writing to the Contact Person no later than Sep 05, 2008.
