Project Description:

Construction and operation of a regulated medical waste (RMW) transfer station located at 100 - 02 Farragut Road, bounded by Farragut Road and East 100th Street in the Canarsie section of Brooklyn. The applicant CMW Industries, LLC proposes the management of 15 tons per day (330 tons per month) of RMW and an undefined quantity of conditionally exempt hazardous waste. The on site storage of hazardous waste is limited to less than ten days pursuant to 6 NYCRR Part 373-1.1(d), an activity not subject to permitting by the NYS Department of Environmental Conservation. CMW Industries proposes to accept waste from Conditionally Exempt, Small Quantity, and Large Quantity Generators such as dentists, radiological facilities, laboratories, hospitals and research laboratories and include fixer and developer waste, formalin, formaldehyde and formaldehyde solutions, xylene, alcohol, mercury and waste mercury. The RMW and the the conditionally exempt hazardous waste will be collected and stored for removal by a licensed hazardous waste transporter. The number of truck trips to and from the facility are estimated at 17 per day. The applicant proposes to operate Monday through Fridays, 9 AM to 7 PM.

Project is an Unlisted Action and will not have a significant impact on the environment. A Negative Declaration is on file. A coordinated review was not performed.

State Historic Preservation Act (SHPA) Determination:

Cultural resource lists and map have been checked. No registered, eligible or inventoried archaeological sites or historic structures were identified at the project location. No further review in accordance with SHPA is required.

Coastal Management:

This project is not located in a Coastal Management area and is not subject to the Waterfront Revitalization and Coastal Resources Act.

Project Description:

The New York State Department of Environmental Conservation (NYSDEC) is pursuing a Department Initiated Modification (DIM) to the State Pollutant Discharge Elimination System (SPDES) Permit (NY 020 0247, DEC Identification #: 2-6308-00006/00001), the Bay Terminals of Rockaway Inc., Amstel Boulevard Facility pursuant to 6 NYCRR Part 750-1.18, New York State's Environmental Benefit Permit Strategy (EBPS). The changes to the permit are as follows:

A settleable solids limitation has been added to outfall 001 in compliance with the guidance limitations for a petroleum storage facility with oil/water separators. The action level for benzene has been changed to a water quality based effleunt limit of 100 ug/l. A short term high intensity monitoring schedule for chemical oxygen demand, total ammonia and total suspended solids has been added. Sampling will be required once a week for a 3 month period to gather data to determine whether the pollutants are consistently present in the effluent and need to be limited. The modification also includes several other minor reporting modifications.

The Bay Terminals of Rockaway Inc, Amstel Boulevard Facility has surface discharge into Vernam Basin, a class I water.

Additional information including the current permit, renewal applications, and supporting documentation may be obtained from or inspected at the DEC central office in Albany. Substantive comments on the permit or requests for hearing or both must be submitted in writing to the contact person. DEC seeks comments on the proposed regulated activity prior to making a final decision on permit issuance.
