Cattaraugus County - The New York State Department of Environmental Conservation (NYS DEC), as lead agency, has determined that the proposed Removal of Undesirable Forest Understory Seedlings and Vegetation on Cattaraugus RA #3, South Valley State Forest will not have a significant adverse environmental impact. The action involves the application of herbicides to beech and birch understory seedlings and to Hay Scented and New York Fern. Herbicide application is the only practical means of control for these interfering stems in this forested area. The herbicide treated area in this project totals approximately 49 forested acres. All beech, striped maple and yellow birch stems will be cut prior to the application of herbicides. The areas will be treated with the commercial herbicide Garlon 4 to control American Beech and Yellow Birch which are undesirable understory species and Round Up Pro to treat fern. Control or eradication of these areas is needed to prevent further colonization and proliferation of these species resulting in negative impacts to forest species diversity.
It is anticipated that the herbicides (Garlon 4 and Round Up Pro) may need to be applied in two applications, one year apart, therefore, the project will begin during the summer of 2008 and end by August 30, 2009. The application method used will be by back pack sprayer and cut stump method. The application will follow label instructions, minimizing risk to both the applicant and the environment.
The project is located in Cattaraugus RA #3, Stands 6, 7 and 9 located west of Perimeter Road in the Town of South Valley, New York.

Chautauqua County - The Town of Chautauqua, as lead agency, has determined that the proposed Adoption of Local Law #5 of 2008 - Revising Wind Energy Facilities Regulations will not have a significant adverse environmental impact. The action involves the adoption of a local law to amend the Town's existing wind energy facility regulations to clarify that the Code Enforcement Officer may issue permits for small wind energy systems and to limit such systems to the Residential-Agricultural (R-A) District. The project is located townwide in the Town of Chautauqua, New York.
