The Department has made a tentative determination to approve this application for a modification of the SPDES permit, issued on May 1, 2006, for the discharge of: Outfall 001: non-detergent washwater and melt off from school busses to an unnamed creek (Class C), and sanitary waste to groundwater; Outfall 002: stormwater to unnamed creek (Class C) & sanitary (bus garage) to groundwater; Outfall 003: discharge to groundwater; Outfall 004: stormwater from Middle School to open swale; Outfall 005: stormwater from High School to open swale; and Outfall 006: stormwater & sanitary (maximum daily limit of 17,000 gpd) from High School to Tributary No.2 to Parker's Pond (Class C), at the applicant's facility, Cato-Meridian Elementary/Middle/High Schools and Bus garage, 2851 Route 370E, Cato, Cayuga County. The modification is to update the permit by adding these existing outfalls to it.

Project Description:
The applicant, with approval from the other owners of the dam, proposes the removal of this privately owned dam (NYSDEC State Dam ID# 073-0337) on Ninemile Creek, located next to the proposed Upper Crown Mill Condominiums in the Village of Marcellus, Onondaga County. The project will include the following:
- A temporary water diversion constructed upstream of the dam to bypass water to a pipe for delivery downstream of the dam;
- Dewatering the impoundment;
- Demolishing and removing the dam; and,
- Removing accumulated sediments from the impoundment and stabilizing the banks with riprap, erosion control blankets and native vegetation.
The application is available for review at the Marcellus Free Library, 32 Maple St, Marcellus (V), NY and at the NYSDEC, 615 Erie Blvd. W., Syracuse, NY. There will be an Informational Meeting at the Marcellus Free Library, Marcellus (V), NY, on August 21, 2008 at 7 PM. The applicant will give a presentation of their proposal and both the applicant and DEC will be available for questions.

Project Description:
The Department of Environmental Conservation (DEC) has received an application to renew State Pollutant Discharge Elimination System (SPDES) # NY 021 4108, for Sandy Creek Big M in Oswego County. This is a pre-existing Private/Commercial/Institutional SPDES permit. DEC has made a tentative determination to renew this permit and set a standard five year term maintaining current effluent limitations and monitoring and reporting requirements. This permit involves the surface discharge of up to 200 gallons per day of treated sanitary waste into Sandy Creek, a class C(T) water. Additional information including the current permit, renewal applications, and supporting documentation may be obtained from or inspected at the DEC central office in Albany. Substantive comments on the permit or requests for hearing or both must be submitted in writing to the contact person. DEC seeks comments on the proposed regulated activity prior to making a final decision on permit issuance.
