Shandaken Tunnel Outlet SPDES Permit General Meeting - August 26, 2008

The New York City Department of Environmental Protection (NYC DEP) hereby gives notice that a meeting will be held from 1:00 p.m. to 3:00 p.m., on Tuesday August 26, 2008, at the NYC DEP office located at 71 Smith Avenue in Kingston, NY.

The meeting is being held in accordance with State Pollutant Discharge Elimination System (SPDES) Discharge Permit No. NY 026-8151, for the Shandaken Tunnel Outlet. NYC DEP will discuss the progress of several projects in the Catskill watershed region. Public input is welcome.

The meeting is open to the public.

Project Title: Notice of Proposed Final Corrective Measures to Address Site Contamination, SABIC Innovative Plastics US, LLC

Project Location: Noryl Avenue, Selkirk, NY 12158

Project Summary: The New York State Department of Environmental Conservation (NYS DEC) and the United States Environmental Protection Agency - Region 2 (US EPA), propose to change the status of interim remedies for preventing and cleaning up groundwater contamination into final remedies. All of the proposed remedies are substantially in place.

Background: The SABIC Innovative Plastics Selkirk facility has been operating since 1967; formerly under the ownership of General Electric Plastics Division. During this operation, the main manufactured product is Noryl Thermoplastic molding material, which has a variety of applications in the automotive, electronics and building industries. Solid and hazardous waste generation, treatment, storage and disposal was conducted at the facility in support of it's manufacturing operations. These included a RCRA permitted landfill, which has been capped and closed, and a variety of other waste handling facilities. Spills and leakage from these facilities have been identified in this and previous permits as 37 Solid Waste Management Units (SWMUs) and one Area of Concern (AOC). At this time, all but four of these SWMUs and the one AOC have been classified as no further action is required (NFA). Those designated as NFA include the 31 SWMUs designated as NFA in the previous permit, and one designated as NFA in this Permit.

The proposed final remedies for the following individual Solid Waste Management Units (SWMU) and Areas of Concern (AOC) are:

(a) Landfill (SWMU #9) - Containment utilizing several control measures to minimize leachate generation and to intercept and contain future groundwater contamination.

(b) Resins Area (SWMU 36) - Monitored natural attenuation and institutional controls to prevent potential exposure to contaminated media in site process areas. Implement additional measures to increase the rate of contaminant degradation if feasible.

(c) Filled Valley Area (SWMU #31) - Monitored natural attenuation and institutional controls to prevent potential exposures to contaminated media and to demonstrate that contamination from the buried drum area is stable and not migrating further through the buried valley fill materials.

(d) A/P Area (AOC 1) - Monitored natural attenuation and institutional controls to prevent potential exposure to contaminated media in site process areas.

(e) Sludge Drying Beds (SWMU #10) - No further action.

Tentative Determination: The New York State Department of Environmental Conservation is proposing final remedies to address the contamination at the SABIC Innovative Plastics US, LLC plant. The proposed final measures were selected because NYS DEC has determined that they will be protective of human health and the environment.

After the public comment period has ended and comments have been reviewed and considered, the Department will select the final remedies for the SABIC Innovative Plastics US, LLC plant. Changes to the proposed final remedies, or the selection of alternate remedies, may be made if public comments or additional data indicate that such changes are warranted.

How to Provide Your Comment: Comments on this proposal must be sent to the attention of Angelo Marcuccio, Environmental Analyst at the NYS DEC - Region 4 Office , 1130 North Westcott Road, Schenectady, NY 12306. In lieu of, or in addition to submission of written comments, any interested person may request a public hearing. A request for a public hearing must be made in writing and must state the nature of the issues to be raised in the hearing.

All written comments and/or requests for a hearing must be submitted no later than September 22, 2008.

All comments will be considered and evaluated in making the final determination to issue the permit. Prior to the issuance of the final permit, NYS DEC will respond to any comments submitted by the public. If warranted, changes will be made in the draft version to address the comments. A notice of the final decision will be sent to each interested citizen or organization who submitted written comments or have requested such notice.
