Notice is herby given that the Office of Mental Retardation and Developmental Disabilities has declared that Hostel #10601 located at 44 Lakeside Drive, Town of Milan (Rhinebeck mailing address), County of Dutchess is no longer useful for State program purposes and has been declared abandoned to the Commissioner of General Services for sale or other disposition as unappropriated State land. This abandonment was approved on July 8, 2008.

Shandaken Tunnel Outlet SPDES Permit General Meeting - August 26, 2008

The New York City Department of Environmental Protection (NYC DEP) hereby gives notice that a meeting will be held from 1:00 p.m. to 3:00 p.m., on Tuesday August 26, 2008, at the NYC DEP office located at 71 Smith Avenue in Kingston, NY.

The meeting is being held in accordance with State Pollutant Discharge Elimination System (SPDES) Discharge Permit No. NY 026-8151, for the Shandaken Tunnel Outlet. NYC DEP will discuss the progress of several projects in the Catskill watershed region. Public input is welcome.

The meeting is open to the public.

Negative Declaration

Orange County - The Town of Chester Town Board, as lead agency, has determined that the proposed Chester Zoning Regulation Amendments 2008 will not have a significant adverse environmental impact. The action involves the revisions and additions to the current Town of Chester zoning regulations in conformance with the comprehensive plan. The following changes are proposed:

Amend Section 98-19E: Outdoor Storage
Add Section 98-29W: Market Rate Senior Housing
Amend Senior Parking Requirements in Off Street Parking Schedule
Amend definition of Buildable Lot Area
Amend SR-1 and AR.3 bulk tables: Accessory uses, Horses
Amend Section 98-9: Undersized Lot setbacks

Ulster County - The Town of Rosendale, as lead agency, has determined that the proposed Wild Rose Subdivision will not have a significant adverse environmental impact. The action involves the approval of a twenty two (22) lot subdivision on 80 acres of land. Included in this action is the construction of a new roadway, utilities, associated drainage facilities and other development improvemenets. The project is located on the easterly and westerly sides of Bruceville Road in the Town of Rosendale, New York.

Positive Declaration

Ulster County - The Town of Lloyd Planning Board, as lead agency, has determined that the proposed Highland Square Commercial Facility may have a significant adverse impact on the environment and a Draft Environmental Impact Statement must be prepared. The action involves the construction of a commercial plaza on a 22.185 ± acre site. The parcel is currently vacant and is located in the Designed Business (DB) Zoning District. Proposed site improvements include clearing and grading the site, and construction of a 100 room hotel (50,000 ± square feet), a 14,000 ± square feet pharmacy with a drive-thru, 53,678 ± square feet of general retail space, 32,400 ± square feet of office space, a 4,000 ± square feet bank with a drive-thru, and 6,000 ± square feet of restaurant space, with associated site improvements, including a parking lot with a total of 882 ± parking spaces, installation of stormwater management facilities, landscaping, lighting, signage, two new highway access driveways, and a new highway signal at the main site entrance. Connection to the municipal water supply system and wastewater facilities is proposed. Access to the project would be provided from NYS Route 299. The project is located on Route 299 in the Town of Lloyd, New York.

Positive Declaration and Public Scoping

Dutchess County - The Town of Rhinebeck, as lead agency, has determined that the Proposed adoption of Town of Rhinebeck Comprehensive Plan, Amendments to the Town of Rhinebeck Zoning Law and the Freshwater Wetlands Law of the Town of Rhinebeck may have a significant adverse impact on the environment and a Draft Environmental Impact Statement must be prepared. Written comments on the draft scope will be accepted until August 25, 2008. A public scoping session will be held on August 14, 2008 at 6:45 p.m. at the Rhinebeck High School, 45 North Park Road, Rhinebeck, NY. The Draft Scoping Document is available at the following websites: www.TheRhinebeckPlan.org and www.rhinebeck-ny.gov and at the Rhinebeck Town Hall, Starr Library and Morton Library. The action involves the proposed adoption of a new Comprehensive Plan for the the Town of Rhinebeck, amendments to the Town's Zoning Law and the adoption of a Wetlands Local Law. The project is located townwide in the Town of Rhinebeck, New York.

Notice of Acceptance of Draft EIS and Public Hearing

Ulster County - The City of Kingston Planning Board, as lead agency, has accepted a Draft Environmental Impact Statement on the proposed Sailor's Cove on the Hudson. A public hearing on the Draft EIS will be held on September 10, 2008 and on October 15, 2008 at 6:00 p.m. at the Kingston City Hall, 420 Broadway, Kingston, NY 12401. Written comments on the Draft EIS will be accepted until November 17, 2008. The action involves the construction of a mixed use development of residential housing, office, retail commercial and restaurant space, along with supporting infrastructure on approximately 76 acres of previous industrial site which was occupied by a brickyard manufacturing business. The project also includes public access to the waterfront and other on-site recreational amenities. The project is located at 200 North Street in the City of Kingston, New York.

Notice of Acceptance of Final EIS

Orange County - The Town of Newburgh Planning Board, as lead agency, has accepted a Final Environmental Impact Statement on the proposed The Polo Club. The action involves the proposed construction of 130 multifamily units amongst 25 buildings. The project will be spread out over approximately 36.7 acres with the R-3 zone where multi-family units are a permitted use at the rate of 6 units per acre. The ACOE wetlands have been delineated and a Jurisdictional Determination has been received. The site has associated stormwater management ponds and ACOE mitigation areas, along with a clubhouse, pool, playground and all-sports court. Sewer lines will be extended along Route 300 and connected to the previously approved Town of Newburgh Plattekill Turnpike Trunk Sewer to accommodate this site and the Driscoll Subdivision across Route 300. The project is located NYS Route 300 adjacent to Jeannie Drive in the Town of Newburgh, New York.
