Public Notice

Availability for Comment on Draft TMDLs

This notice announces the availability of a DRAFT Total Maximum Daily Load (TMDL) document proposed by New York State Department of Environmental Conservation (NYS DEC) to address each of four specific waterbodies:

Lake Oscawana, Putnam County
Cossayuna Lake, Washington County
Lake Salubria, Steuben County
Findley Lake, Chautauqua County

These are lakes that are impaired by phosphorus. Public comment on these documents will be accepted for 30 days, through August 22, 2008.

Background: States are required by Section 303(d) of the Clean Water Act and the U. S. Environmental Protection Agency's (EPA's) implementing regulations (40 CFR Part 130) to develop TMDL plans for waterbodies and pollutants where water quality standards are not being met. By definition, a TMDL specifies the allowable pollutant loading from all contributing sources (e.g., point sources, nonpoint sources, and natural background) at a level necessary to attain the applicable water quality standards with seasonal variations and a margin of safety that takes into account any lack of knowledge concerning the relationship between the sources of the pollutant and water quality. In essence, a TMDL defines the assimilative capacity of the waterbody to absorb a pollutant and still meet water quality standards.

The proposed phosphorus TMDLs for Cossayuna Lake, Lake Salubria and Findley Lake will rely on the elimination of loading from on-site septic systems to address existing water quality impairments while the Lake Oscawana TMDL will focus on reductions from developed land regulated under the general permit for stormwater (MS4 program).

Positive Declaration and Public Scoping

Chautauqua County - The Town of Westfield, as lead agency, has determined that the proposed Babcock & Brown Renewable Holdings, Inc. Ripley - Westfield Wind Farm may have a significant adverse impact on the environment and a Draft Environmental Impact Statement must be prepared. Written comments on the draft scope will be accepted until August 8, 2008. A public scoping session will be held on July 29, 2008 from 1:00 p.m. to 3:00 p.m. at the Westfield Academy and Central School, 203 East Main Street, Westfield, NY. The action involves the installation and operation of an approximately 125 megawatt wind energy facility consisting of up to 83 wind turbines, an electrical substation, and an interconnection to an existing 230 kV transmission line. The project is located within an area in the Towns of Ripley and Westfield, New York, generally bounded on the north by Belson Road, on the east by the Westfield-Sherman Road, on the south by the southern border of each town, and on the west by Route 76.
