Project Description: The action involves a large-scale project consisting of seven single-family dwellings on individually owned lots, 17 multiple-family dwellings (townhouses) containing a total of 66 dwelling units on lands to be owned by a homeowners association; and a lodge/restaurant containing 25 tourist accommodation units (rooms), a 150 seat restaurant/conference room, lounge, fitness center and swimming pool. Project Description: The project is briefly described as the construction of a train station in phases. Phase I includes the construction of a rail siding, pavilion and associated infrastructure (i.e., stormwater control devises, parking area, landscaping, etc.). Phase II includes the construction of a 20.5 foot tall, 21.5 foot by 67 foot train station with two attached 16 foot by 38 foot canopies (thereby making the overall structure 21.5 feet in width and 143 feet in length). Upon completion of the train station the pavilion is proposed to be removed.

Project Title: Whiteface View

Location: NYS Route 86, Town of Wilmington, Essex County

Comment Period Ends: August 6, 2008

Project Description: The project is a subdivision into sites involving a highway critical environmental area and conversion of a pre-existing resort hotel structure to single family residential use. The applicant proposes to remove hotel from the 5.39 ± acre site and replace it with three new structures each containing four, 3 bedroom dwelling units. Wastewater treatment will be handled through six separate systems with each system servicing two units. The proposed average size of each unit is 2,063 square feet for a maximum square footage of all units being 24,765 square feet (i.e., the size of the existing structure plus 25%). Water will be supplied by the Town of Wilmington public water system. Access to the site will be by an existing driveway from NYS Route 86 with parking for each unit located behind the proposed structures. Stormwater will be handled by a swale and existing pond at the back of the proposed structures. The pond will overflow through a drop-outlet control structure to another swale that will discharge to the roadside ditch. Utilities will be brought to the site underground along the existing driveway. The applicant is seeking conceptual review of the project by the Agency's Regulatory Programs Committee, pursuant to 9 NYCRR 572.3 of Agency Regulations. The matter may be on the Agency August agenda and comments for that purpose are due by August 6, 2008. However, there is an additional 30 day comment period after the review by the Regulatory Programs Committee, and then the Committee will provide its written recommendations.


Public Notice

Availability for Comment on Draft TMDLs

This notice announces the availability of a DRAFT Total Maximum Daily Load (TMDL) document proposed by New York State Department of Environmental Conservation (NYS DEC) to address each of four specific waterbodies:

Lake Oscawana, Putnam County
Cossayuna Lake, Washington County
Lake Salubria, Steuben County
Findley Lake, Chautauqua County

These are lakes that are impaired by phosphorus. Public comment on these documents will be accepted for 30 days, through August 22, 2008.

Background: States are required by Section 303(d) of the Clean Water Act and the U. S. Environmental Protection Agency's (EPA's) implementing regulations (40 CFR Part 130) to develop TMDL plans for waterbodies and pollutants where water quality standards are not being met. By definition, a TMDL specifies the allowable pollutant loading from all contributing sources (e.g., point sources, nonpoint sources, and natural background) at a level necessary to attain the applicable water quality standards with seasonal variations and a margin of safety that takes into account any lack of knowledge concerning the relationship between the sources of the pollutant and water quality. In essence, a TMDL defines the assimilative capacity of the waterbody to absorb a pollutant and still meet water quality standards.

The proposed phosphorus TMDLs for Cossayuna Lake, Lake Salubria and Findley Lake will rely on the elimination of loading from on-site septic systems to address existing water quality impairments while the Lake Oscawana TMDL will focus on reductions from developed land regulated under the general permit for stormwater (MS4 program).

Negative Declaration

Clinton County - The Town of Plattsburgh Planning Board, as lead agency, has determined that the proposed North Country Plaza Redevelopment Site Plan 2008 will not have a significant adverse environmental impact. The action involves a request to demolish the existing 111,000 ± square foot building and to construct and subdivide a multi-phased master plan build out of 571,000 ± square foot of commercial and retail space with 2,426 parking spaces, access drives, and stormwater management on approximately 67.0 acres of land. The project is located on Route 9 North, in the Town of Plattsburgh, New York.

Saratoga County - The Corinth Town Board, as lead agency, has determined that the proposed Hamm Road Zoning Reclassification and Zoning Map Amendment will not have a significant adverse environmental impact. The action involves the adoption of a Local Law amending the Land Use Map of the Town of Corinth to change the zoning classification of 8 parcels totalling approximately 26 acres from Moderate Density Residential (R-3) land use district to Mixed Residential (R-2) land use district. The project is located on Hamm Road, Corinth, New York.

Washington County - The Village Board of the Village of Hudson Falls, as lead agency, has determined that the proposed Local Law No. 5 of 2008 - Amendment to Chapter 215 "Zoning" and Chapter 174 "Streets and Sidewalks" of the Code will not have a significant adverse environmental impact. The action involves the amending of Section 215-8 of the Zoning Law and Chapter 174. The project is located throughout the Village of Hudson Falls, New York.

Notice of Acceptance of Draft Generic EIS and Public Hearing

Saratoga County - The Town of Malta Town Board, as lead agency, has accepted a Draft Generic Environmental Impact Satement (GEIS) on the proposed Saratoga Medical Park at Malta Planned Developmment District (PDD). A public hearing on the Draft GEIS will be held on July 28, 2008 at 6:30 p.m. at the Town of Malta Town Hall. Writtten comments on the Draft GEIS will be accepted until August 25, 2008. The action involves a 160 bed nursing home, a 120,000 square foot assisted nursing facility, a 440,000 square foot hospital, a 60,000 square foot ambulatory care center, a 20,000 square foot drugstore, 100,000 square foot of medical office space, 30 detached senior townhouses, community uses and additional accessory uses for animal husbandry. Parking and landscaping would be provided for the facility and approximately 75 acres would be kept as open space on the project site. The project is located on Route 67 in Malta, New York.
