Project Description:

PLEASE NOTE: This proposed project is located on property currently owned by E. Tetz & Sons, however the permit applications described below are being applied for by Panattoni Development Company, LLC, and the the resulting permits would be issued to that Company.
The following permit applications have been submitted for the proposed subdivision of the 107-acre former Pine Lane Sand & Gravel mine site, to develop it with 5 single-family homes and two warehouses totaling 747,240 square feet:
---A Protection of Waters Permit to cross a Tributary of Monhagen Brook (Water Index #: H-139-13-52-2; Class B) for the installation of a precast 40-foot wide concrete arch culvert to allow proposed Road-A to cross the stream. ---Repair of an existing culvert along the subtributary of Monhagen Brook (H-139-13-52-2-1a; Class B) to construct entrance Road-B which would lead to the second warehouse. ---A Stormwater Pollution Prevention Plan (SWPPP) was reviewed by the Department and it was found to satisfy the requirements of the State Pollutant Discharge Elimination System (SPDES) General Permit for Stormwater Discharges from Construction Activities. ---A Sanitary SPDES General Permit for each of the two warehouses which would have subsurface sanitary discharges treated by a septic tank and leach fields, with design flows of 1,500 gpd and 2,250 gpd. Industrial wastes would be allowed in these sanitary disposal systems. This proposed 7-lot residential/warehouse subdivision is located between NYS Route 6 and Kirby Town Road, in the Town of Wawayanda, Orange County, NY.

State Environmental Quality Review (SEQR) Determination:

Project is a Type I action and will not have a significant effect on the environment. A coordinated review with other agencies was performed and a Negative Declaration is on file.

SEQR Lead Agency: Wawayanda Town Planning Board

State Historic Preservation Act (SHPA) Determination:

A cultural resources survey has been completed. Based on information provided in the survey report, the New York State Office of Parks, Recreation and Historic Preservation (OPRHP) has determined that the proposed activity will have no impact on registered or eligible archaeological sites or historic structures. No further review in accordance with SHPA is required.

Coastal Management:

This project is not located in a Coastal Management area and is not subject to the Waterfront Revitalization and Coastal Resources Act.

Opportunity for Public Comment:

Comments on this project must be submitted in writing to the Contact Person no later than Aug 01, 2008.

Project Description:

This proposal involves improvements to two storm water basins located within NYS regulated Freshwater Wetland L-3 (Class 1). The basins will be lowered using surface pumps and the water will be discharged outside of the regulated 100 foot adjacent area. The basins will then be excavated to a depth of 8 feet from the current depths of 6 feet. The excavated material will be dewatered and disposed of on site outside of the regulated 100 foot adjacent area. The inlet and outlet structures will be maintenanced. The project also requires the construction of access roads within the 100 foot adjacent area of Freshwater Wetland L-3.

Cultural resource lists and map have been checked. No registered, eligible or inventoried archaeological sites or historic structures were identified at the project location. No further review in accordance with SHPA is required.

This project is not located in a Coastal Management area and is not subject to the Waterfront Revitalization and Coastal Resources Act.
