Project Description:

The applicant proposes to resurface an existing trail within the 100-foot adjacent area of State-designated Freshwater Wetland WT-1 (Class II). The project site is located on the north side of Fishkill Creek, between the Metro North rail line and South Avenue. As proposed approximately 1,800 linear feet of the existing 8 foot wide trail will be resurfaced with about 6 inches of compacted item #4 gravel. Three trailside resting stations with benches will also be installed and selective clearing of trees and brush in those areas will occur. In addition new walkway approximately 140 feet long will be installed outside the regulated area. The 6-foot wide, wooden walkway will be constructed next to Fishkill Creek over an existing sewer main located on existing concrete piers.

The applicant proposes disturbances to NYS Freshwater Wetland KE-28, its regulated 100-foot Adjacent Area and a Class C(t) protected stream located entirely within the wetland (NYS Waters Index # H-136-6-7-1-1, an unnamed sub-tributary of the Rhinebeck Kill) The proposed work is in conjunction with the development of a two-lot subdivision of a 25-acre parcel and construction of one new home in the Town of Rhinebeck. The proposed disturbances include widening of the existing access drive in the wetland adjacent area and construction of a new 12-foot drive across 110 linear feet of wetland with placement of a 57 inch by 38 inch oval culvert to span the stream and two additional 24 inch culverts in the wetland. The new house, well, and septic system are outside the wetland and adjacent area.

Project Description:

The NYS Department of Transporation proposes to impact federally-regulated wetlands and the 100-foot adjacent areas of State-designated Freshwater Wetlands MD-7 and MD-10, located along NYS Route 17 between Exit Numbers 116 and 121. The work is associated with the rehabilitation and upgrade of NYS Route 17 to interstate standards for the I-86 designation. The work will result in the permanent filling of approximately 0.5 acres of federally regulated wetlands and the temporary disturbance of up to 0.2 acres. Permanent and temporary impacts to the 100-foot adjacent areas of State-designated freshwater wetlands will be approximately 0.7 and 5.2 acres, respectively. Much of the 100-foot adjacent area disturbed is already existing roadway. To mitigate wetland impacts, existing wetlands located along highway rights-of-way within the project area will be expanded by a total of approximately 1.68 acres. Work within the adjacent areas of State-designated freshwater wetlands will be authorized under the Department's General Freshwater Wetland permit issued to NYSDOT for Minor Earth Fills Associated with the Rehabilitation or Replacement of Existing Transporation Facilities (DEC No. 0-000-01129/00004; GP-06-02).A stormwater pollution prevention plan has also been prepared for this project in accordance with the Department's General SPDES Permit for Stormwater Discharges from Constrution Activities (GP-0-08-001).

The Department has prepared a draft permit and has made a tentative determination to renew the Wyeth Pharmaceuticals Title V permit.

This facility is engaged in the manufacture, research and development of pharmaceutical, nutritional, biological and other related products. Major Source for the following pollutants: Oxides of Nitrogen, Volatile Organic Compounds, Particulate and PM-10. The facility has a Prevention of Significant Deterioration (PSD) Permit for it's CoGen Unit. The facility is subject to provisions of 6NYCRR Parts 212, 226, 227, 231 and 233 as well as Federal NSPS Requirements 60 Dc and GG. The facility has established a limit on Hazardous Air Pollutant Emissions to stay below the 40CFR 63 GGG (pharmaceutical MACT) 25 ton threshold.

In accordance with 6NYCRR Parts 621.7(b)(9) and 201-6.4(c), the Administrator of the United States Environmental Protection Agency (USEPA) has the authority to bar issuance of any Title V Facility Permit if it is determined not to be in compliance with applicable requirements of the Clean Air Act or 6NYCRR Part 201.

This proposal involves improvements to two storm water basins located within NYS regulated Freshwater Wetland L-3 (Class 1).
