The Department is prepared to issue an individual Water Quality Certification for the installation of a 40' culvert in the Class C unnamed tributary of Oatka Creek for an access road to a new farm market stand.
While the access road and building are outside the 100 foot adjacent area of State Regulated Freshwater Wetland, CH-30, construction of a newly drilled water well and the clearing of vegetation within the adjacent area was performed without the required Article 24 permit and will require remediation by the applicant per the Departments requirements.

Project Description:

The Department has prepared a draft permit and has made a tentative determination to issue a modification to the Title V Facility Permit for the Seneca Energy II LLC Seneca Energy Landfill Gas to Energy Facility, located at NYS Route 414 in the Renewable Resources Park, which burns scrubbed landfill gas from the Seneca Meadows Landfill for generation of electrical power. Seneca Energy LLC proposes to install and operate an emergency diesel fueled IC engine to power a 800 ekW electricity generator for a maximum of 250 hours per year when utility outages occur. The generator will be housed in its own sound attenuated enclosure. It will be located on the northeast side of the existing permitted LFG fueled electricity generation building. The applicant also proposes to make changes to the monitoring conditions for the existing permitted engines.

The facility is currently permitted for eighteen engines. In addition to the current state and federal requirements for these engines, the addition of the emergency diesel generator will result in additional emissions which will trigger additional state and federal requirements. The combustion of diesel fuel has the potential to emit nitrogen oxides (NOx), carbon monoxide (CO), volatile organic compounds (VOC), sulphur oxides (SOx), fine particulates with diameters less than 10 micros (PM10), and VOC and hazardous air pollutants that are defined as regulated by New York State and USEPA. The emergency diesel fuel generator is subject to 40 CFR 60 Subpart IIII for emissions standards for emergency engines. The modification will not result in any changes to the caps on NOx or CO that were authorized in the previous permit.

In accordance with 6NYCRR Parts 621.7(b)(9) and 201-6.4(c), the Administrator of the United States Environmental Protection Agency (USEPA) has the authority to bar issuance of any Title V Facility Permit if it is determined not to be in compliance with applicable requirements of the Clean Air Act or 6NYCRR Part 201.

Persons wishing to inspect the subject Title V files, including the application with all relevant supporting materials, the draft permit, and all other materials available to the DEC (the "permitting authority") that are relevant to this permitting decision should contact the DEC representative listed below. DEC will evaluate the application and the comments received on it to determine whether to hold a public hearing. Project Description:

The New York State Department of Environmental Conservation (NYSDEC) is pursuing a Department Initiated Modification (DIM) to the State Pollutant Discharge Elimination System (SPDES) Permit (NY 002 7171, DEC Identification #: 8-5434-000006/00001), the Town of Ontario Wastewater Treatment Facility pursuant to 6 NYCRR Part 750-1.18, New York State's Environmental Benefit Permit Strategy (EBPS). The changes to the permit are as follows: The addition of permt limits for Total Residual Chlorine, Copper and Zinc. Seasonal limits for Total Nitrogen (N) as Ammonia (NH3) are also included. The permit limit for CBOD5 has been changed to BOD5 per the Water Quality assessment. The limit for Total suspended Solids (TSS) has been changed from 30 Day Arithmetic Mean (DAM) to Daily Maximum (DM) per the water quality assessment, therefore, the 7DAM limit has been removed. The modification also includes several other minor reporting modifications. The Town of Ontario Wastewater Treatment Facility has surface discharge into Bear Creek, a class C water. Additional information including the current permit, renewal applications, and supporting documentation may be obtained from or inspected at the DEC central office in Albany. Substantive comments on the permit or requests for hearing or both must be submitted in writing to the contact person. DEC seeks comments on the proposed regulated activity prior to making a final decision on permit issuance.

Project Description:

The applicant is proposing to stabilize several sections of Keuka Outlet streambank through the use of stone rip rap. Approximately 850' of streambank would be stabilized in three separate sections. Additionally, an existing culvert will be replaced, two streambank wash-out areas will be filled with stone and an existing bridge will be improved. Prior to construction, the applicant would be required to conduct a field investigation to determine if protected plant species, and/or their habitat, are located within the project corridor.
