Project Description:

The New York State Department of Environmental Conservation (NYSDEC) is pursuing a Department Initiated Modification (DIM) to the State Pollutant discharge Elimination System (SPDES) Permit (NY-021 3781, DEC #7-0324-00042/00001) the Town of Chenango, Broome County, Northgate Sewage Treatment Plant facility pursuant to 6NYCRR Part 750-1.18, New York State's Environmental Benefit Permit Strategy (EBPS). The changes to the permit are as follows:

  1. In accordance with New York State's Chesapeake Bay Tributary Strategy, action levels for total Nitrogen and Phosphorus and a compliance schedule requiring optimization of treatment for total Nitrogen and Phosphorus have been added to the permit.
  2. There is currently no effluent limit on mercury in the Northgate permit. A 6-month long monitoring program for mercury has been added to the permit.
  3. Administrative changes such as the updating of the Town's mailing address have been made.

Additional information including the current permit, and supporting documentation may be obtained from or inspected at the DEC's Cortland Office. Substantive comments on the permit or requests for a hearing or both must be submitted in writing to the contact person. DEC seeks comments on the proposed regulated activity prior to making a final decision on permit issuance.

Filed application documents, and Department draft permits where applicable, are available for inspection under the provisions of the Freedom of Information Law during normal business hours at the address of the contact person.

State Environmental Quality Review (SEQR) Determination:

Project is an Unlisted Action and will not have a significant impact on the environment. A Negative Declaration is on file. A coordinated review was not performed.

The proposed activity is not subject to review in accordance with SHPA. The permit type is exempt or the activity is being reviewed in accordance with federal historic preservation regulations.

Applicant proposes the construction of a 103 unit residential development at the existing Fisher Bay Marina. The development will include the installation of roadways, sanitary sewer, stormwater facilities and development amenities (community center, walking trails, marina improvements). Impacts will include placement of fill within 0.5 acre of federally-protected wetland area, as well as 0.69 acre of state-protected class II wetland CL-8 adjacent area. The site is along Barrett Lane and Willey Road in the Town of Sullivan.

No further review in accordance with SHPA is required.

This project is not located in a Coastal Management area and is not subject to the Waterfront Revitalization and Coastal Resources Act.

The Department of Environmental Conservation (DEC) has received an application to renew State Pollutant Discharge Elimination System (SPDES) # NY 015 4971, for Aura A Cole Elementary School in Oswego County. This is a pre-existing Private/Commercial/Institutional SPDES permit. DEC has made a tentative determination to renew this permit and set a standard five year term maintaining current effluent limitations and monitoring and reporting requirements. This permit involves the surface discharge of up to 9,000 gallons per day of treated sanitary waste into Tributary #7, Oneida Lake, a class C water. Additional information including the current permit, renewal applications, and supporting documentation may be obtained from or inspected at the DEC central office in Albany. Substantive comments on the permit or requests for hearing or both must be submitted in writing to the contact person. DEC seeks comments on the proposed regulated activity prior to making a final decision on permit issuance.
