This proposal involves the removal of accumulated sediment from within Jackson Creek [Water Index # H-95-10-2, Class C(t)] located within the 100' adjacent area of NYS Freshwater Wetland VB-41 (Class 2). Sediments will be removed from approximately 120 linear feet of the stream in the vicinity of a 4 culvert system under Wisseman Rd. The work will be performed in two stages and stream flow will be channeled away from the work area with the use of sand bag cofferdams. The removed sediment will be transported to the Town of Union Vale Highway Garage.

Project Description:

The Department has prepared a draft permit and has made a tentative determination to issue a Title V Renewal for the Ball Metal Beverage Container Corporation located in the Town of Wallkill, Orange County, New York. The facility manufactures two piece aluminum beverage cans. The emissions are from the cutting and forming of the can bodies and the coating and decorating operations. The facility emits a number of contaminates such as Volatile Organic Compounds (VOC), Hazardous Air Pollutants (HAP) and Oxides of Nitrogen (NOx). The facility is subject to VOC in paint requirements of both NYCRR Part 228 and 40CFR 60WWW. The facility operates a Catalytic Oxidizer to control both VOC and HAP.

In accordance with 6NYCRR Parts 621.7(b)(9) and 201-6.4(c), the Administrator of the United States Environmental Protection Agency (USEPA) has the authority to bar issuance of any Title V Facility Permit if it is determined not to be in compliance with applicable requirements of the Clean Air Act or 6NYCRR Part 201.

The applicant (New York City Department of Environmental Protection) is proposing to conduct stream bed and bank modifications to approximately 1,000 feet of the Chestnut Creek (NYS water index # H-139-14-48, Class At) in order to conduct slope stabilization activities and repair an existing sanitary sewer line crossing. The proposed project also involves temporarily diverting the flow of Chestnut Creek in order to facilitate the construction of an artificial stream bed and bank away from the toe of the failing slope using multiple engineered structures. The site is located approximately 650 feet east of the Route 42 and Route 55 intersection in the hamlet of Grahmsville.

The applicant proposes to restore approximately 1.3 acres of previously-filled wetlands within State-designated Freshwater Wetland F-74 (Class III) and construct a stormwater detention basin within the wetland 100-foot adjacent area.
