Negative Declaration

Cattaraugus County - The New York State Department of Environmental Conservation (NYS DEC), as lead agency, has determined that the proposed Removal of Undesirable Forest Understory Seedlings on Cattaraugus RA #3, South Valley State Forest will not have a significant adverse environmental impact. The action involves the application of herbicides to beech and birch understory seedlings and to Hay Scented and New York Fern. Herbicide application is the only practical means of control for these interfering stems in this forested area. The herbicide treated area in this project totals approximately 80 forested acres. The areas will be treated with the commercial herbicide Accord SP (EPA Reg. No. 62719-332) to control American Beech and Yellow Birch which are undesirable understory species and Oust XP (EPA Reg. No. 352-601) to treat ferns. Control or eradication of these areas is needed to prevent further colonization and proliferation of these species resulting in negative impacts to forest species diversity.

It is anticipated that the herbicides (Accord SP and Oust XP) may need to be applied in two applications, one year apart; therefore, the project will begin approximately June 2008 and end August 30, 2009. The application method used will be by vehicle-mounted sprayer within the project area. The application will follow label instructions minimizing risk to both the applicant and the environment.

The project is in the Cattaraugus RA #3, Stands 6, 7 and 9 which is located west of Perimeter Road in the Town of South Valley, New York.

Erie County - The Town of Marilla, as lead agency, has determined that the proposed Local Law No. 3 of 2008 will not have a significant adverse environmental impact. The action involves the rezoning of approximately 16.22 acres of land from A-Agricultural to B-Business. The project is located at Two Rod Road and Clinton Street in the Town of Marilla, New York.

Positive Declaration and Public Comment Period

Erie and Wyoming Counties - The Town of Sardinia Planning Board, as lead agency, has determined that the proposed Tri-County Business Park may have a significant adverse impact on the environment and a Draft Environmental Impact Statement must be prepared. Written comments on the draft scope will be accepted until July 14, 2008. The action involves the construction of a new roadway and utility infrastructure for the future development of the 210 acre Tri-County Business Park which straddles the Erie County and Wyoming County line. Approximately 183 acres are located in the Town of Sardinia and 28 acres in the Town of Arcade. The existing zoning will allow for a business/light industrial development with building lot coverage up to 40% in the Town of Sardinia and light industrial/highway commercial with building lot coverage up to 50% in the Town of Arcade. Water mains will be installed from the Village of Arcade and/or the Town of Yorkshire to the proposed business park. Sewer lines will also be installed from the Village of Arcade to connect the business park to the Village of Arcade Wastewater Treatment Plant. The project is located at NYS Route 16 in the Town of Sardinia, New York.
