Project Description:

The applicant owns two terminals on Shippers Road. One was previously owned by Coastal and the Coastal facility discharged stormwater via the sanitary sewer under permit by Binghamton-Johnson City Joint Sewer Authority. Buckeye has proposed that the stormwater from the former coastal facility be authorized under the currently held Buckeye permit. Accordingly, Buckeye has proposed to increase the average daily discharge rate from 12,400 gpd to 50,000 gpd.
The Department has made a tentative determination to issue a permit for a State Pollutant Discharge Elimination System permit under Article 17 of the Environmental Conservation Law. The modified permit would include the following: changing the flow limit to a monitor only requirement, increasing or establishing limits for the following parameters: oil and grease: 15 mg/l, benzene: 0.001 mg/l, toluene: 0.05 mg/l, xylenes: 0.05 mg/l, ethylbenzene: 0.05 mg/l. This tentative determination indicates that the discharge regulated under this statute is considered to satisfy regulatory standards for permit issuance, based on information available to the Department at this time. As a tentative determination, the Department seeks comments on the proposed regulated activity prior to making a final decision on permit issuance. As such, this tentative determination does not signify department approval for or endorsement of the activity for which a permit is sought or for the overall proposed project.

Project Description:

Applicant proposes to conduct gravel removal and bank restoration in three locations along the Otselic River to address streambank erosion and flooding. At Site 1, a 125' x 30' gravel bar will be removed, at Site 2, a 300' x 30' gravel bar will be removed, and at Site 3 a 30' section of washed out bank will be backfilled and revegetated.
