Project Description:

The company has applied to modify its permit to excavate an additional 50 foot lift within its active "north" quarry area located on the west side of NYS Route 32, approximately 1.5 miles north of the hamlet of Highland Mills.. This excavation will establish a new quarry floor elevation at approximately 290 feet above mean sea level(MSL) from the currently permitted elevation of 340 feet above MSL. The total area of quarry to be affected by this mining is approximately 13.4 acres within the existing 24.5 acre "north" quarry. The final reclamation of this quarry will remain the same, a lake approximately 28.7 acres in size with a maximum depth of approximately 95 feet. All benches, each approximately 50 feet in width, above the surface water elevation will be reclaimed with fill and soil sufficient to enable revegetation including plantings of native trees and shrubs.

State Environmental Quality Review (SEQR) Determination:

Project is a Type I action and will not have a significant effect on the environment. A coordinated review with other agencies was performed and a Negative Declaration is on file.

SEQR Lead Agency: NYS Department of Environmental Conservation

State Historic Preservation Act (SHPA) Determination:

The proposed activity is not subject to review in accordance with SHPA. The permit type is exempt or the activity is being reviewed in accordance with federal historic preservation regulations.

Coastal Management:

This project is not located in a Coastal Management area and is not subject to the Waterfront Revitalization and Coastal Resources Act.

Opportunity for Public Comment:

Comments on this project must be submitted in writing to the Contact Person no later than Jul 11, 2008.

Project Description:

Applicant is proposing to install a 48 inch diameter polyethylene culvert within a tributary of Cattail Brook (NYS water index # D-70-20-25-8-4, Class B) to access the 93 acre vacant woodland parcel via a 12 foot wide gravel driveway. The subject property is located on the southern side of Shandelee Road (County Route 149) west of the hamlet of Shandelee. The proposed location of the culvert is also located within the 100 foot adjacent area of State regulated freshwater wetland LM-22.
