Project Description:

The New York State Department of Environmental Conservation (NYSDEC) is pursuing a Department Initiated Modification (DIM) to the State Pollutant Discharge Elimination System (SPDES) Permit (NY010 4809, DEC Identification #: 1/4720/00355-00008), the Suffolk County Sewer District #3 - Southwest Plant pursuant to 6 NYCRR Part 750-1.18, New York State's Environmental Benefit Permit Strategy (EBPS). This is an update of the Notice of Intent to Modify dated 7/20/07 which was published both in the Environmental Notice Bulletin and Newsday on 8/1/07. The changes to the permit are as follows: An interim limit of 3.0 mg/l has been added for Total Residual Chlorine has been placed in the permit during construction of the UV system. A water quality based effluent limit of 14.6mg/l for ammonia was added to the permit. Testing for mercury levels using EPA Method 245 have been added. The department may modify the permit to require a more sensitive method if discharge levels fall below the detection level of EPA Method 245. A requirement to perform a Pollutant Minimization Plan for mercury has been added. The following action levels have been revised to reflect current discharge levels: Arsenic, thallium, zinc, tetrachloroethylene, bis (2-ethylhexyl), phthalate, chloroform, toluene, total phenolics. A requirement to perform 4 quarters of toxicity testing once every 5 years has been added. A sludge management plan compliance schedule has been added. A requirement to submit a Comprehensive Sludge Treatment and Management Disposal Plan has been added. Additional pretreatment conditions have been added to control the amount of waste accepted by the leachate and scavenger waste collection system and to document the daily receipt of waste. The modification also includes several other minor reporting modifications. The Suffolk County Sewer District #3 - Southwest Plant has surface discharge into the Atlantic Ocean, a class SA water. DEC seeks comments on the proposed regulated activity prior to making a final decision on permit issuance.

Project Description:

The Department has prepared a draft permit and has made a tentative determination to issue a renewal of the existing Air Title V permit for this facility The facility currently landfills ash residue that is generated at the Hempstead Resource Recovery Facility. A hydrogen sulfide control system has been added to reduce H2S concentrations in the landfill gas collected prior to burning in the control flare, thereby reducing sulphur dioxide from the site.

In accordance with 6NYCRR Parts 621.7(b)(9) and 201-6.4(c), the Administrator of the United States Environmental Protection Agency (USEPA) has the authority to bar issuance of any Title V Facility Permit if it is determined not to be in compliance with applicable requirements of the Clean Air Act or 6NYCRR Part 201.

Persons wishing to inspect the subject Title V files, including the application with all relevant supporting materials, the draft permit, and all other materials available to the DEC (the "permitting authority") that are relevant to this permitting decision should contact the DEC representative listed below.
