Project Description:

The Department has prepared a draft permit and has made a tentative determination to issue a modification State Facility Permit for the construction and operation of Tank 10 to install an Internal Floating Roof (IFR) into an existing fixed roof storage tank. The fixed roof storage tank is identified as Tank 10 and has a storage capacity of 11,281,000 gallons. Following the installation of the IFR the tank will be used for the storage of gasoline, fuel ethanol, or mixture of both gasoline and fuel ethanol. The terminal facility is located at 552 River Road, Glenmont, NY 12077, Town of Bethlehem, County of Albany, owned by Center Point Terminal Company. The facility is a petroleum bulk storage terminal with truck and marine loading racks.

Persons wishing to inspect the subject Air State Facility files, including the application with all relevant supporting materials, the draft permit, and all other materials available to the DEC (the "permitting authority") that are relevant to this permitting decision should contact the DEC representative below. DEC will evaluate the application and the comments received on it to determine whether to hold a public hearing. Project Description:

The applicant proposes to discharge 1,800 gallons per day of treated sanitary wastewater to a tributary to the Murderers Creek, a Class C waterbody from recirculation sand filters at the applicant?s facility located at 763 Scoharie Turnpike, in the Town of Athens. The applicant plans to treat domestic sewage collected from two buildings at the facility location.

The Department has made a tentative determination to issue a permit for a State Pollutant Discharge Elimination System permit under Article 17 of the Environmental Conservation law. This tentative determination indicates that the discharge regulated under this statute is considered to satisfy regulatory standards for permit issuance, based on information available to the Department at this time. As a tentative determination, the Department seeks comments on the proposed regulated activity prior to making a final decision on permit issuance. As such, this tentative determination does not signify Department approval for or endorsement of the activity for which a permit is sought or for the overall proposed project.

A draft permit is available for inspection and comment at the DEC Region 4 Office.

The department must consult further with OPRHP before making a final decision regarding the issuance of the permit.

Coastal Management:

This project is not located in a Coastal Management area and is not subject to the Waterfront Revitalization and Coastal Resources Act.
