Project Description:

The applicant proposes to reconstruct the Belt Parkway bridge over Rockaway Parkway. The work includes replacement of eastern and western outfall structures which discharge into Jamaica Bay and the installation of stormwater swales (BMPs). The project area will be restored upon project completion and impacts from construction activity are to be mitigated as part of the overall Belt Parkway mitigation project previously approved by NYSDEC.

Project Description:

The Department has made a tentative determination to renew and modify an existing permit for existing discharges of treated wastewater pursuant to 6 NYCRR Part 750-1.18, the Environmental Benefit Permit Strategy (EBPS). The discharge is directed into Newtown Creek (Class SD). Compared to the existing permit that this modified permit will replace, the following significant changes are proposed: 1) Add additional monitoring for Settleable Solids and Ethylbenzene at outfall 002. 2) Special Conditions, Industry Best Management Practices - a requirement for the preparation and submission of a BMP plan has been added. 3) A schedule of compliance has been added to the permit to determine if Naphthalene is present in the effluent. If Naphthalene is detected, the permit may be reopened and a limit or action level for Naphthalene added to the permit.

State Environmental Quality Review (SEQR) Determination:

Project is an Unlisted Action and will not have a significant impact on the environment. A Negative Declaration is on file. A coordinated review was not performed.

SEQR Lead Agency: None Designated

State Historic Preservation Act (SHPA) Determination:

Cultural resource lists and map have been checked. No registered, eligible or inventoried archaeological sites or historic structures were identified at the project location. No further review in accordance with SHPA is required.

Coastal Management:

This project is located in a Coastal Management area and is subject to the Waterfront Revitalization and Coastal Resources Act.
