Project Description:

The applicant proposes the creation of a new cell ( cell #7 ) at the existing Town of Babylon Southern Ashfill site. This will require both the vertical and lateral expansion of the existing facility. The proposed expansion would increase the capacity of the existing ashfill by approximately 1,000,000 cubic yards. The principle features of the design include reclamation of the on-site recharge basin by backfilling with recycled concrete aggregate(new cell#7), a double-composite liner system over the Cell 7 area, two-tiered reinforced soil walls along the perimeter of Cell 7 followed by a third upper wall for the vertical expansion over the new ashfill ( Cell 7) and the existing Southern Ashfill, a final cover system over all areas of expanded ash placement, and a comprehensive storm water management system that uses a combination of two off site recharge basins and underground leaching pools to handle run off from the site and the immediate surrounding area. The applicant has met the requirements of the NYSDEC Environmental Justice and Permitting Policy ( CP-29). Variances have been requested as part of this application.

Project Description:

The Department has prepared a draft permit and has made a tentative determination to issue this request for modification of the existing Title V permit for the purpose of establishing certified Emission Reduction Credits(ERC) for past emission reductions which are the result of over-controlling for nitrogen oxide(NOx) emissions from the two existing municipal waste combustor units. The NOx emissions will be limited to 245 tons per year, with a daily 24 hour block average of 150 ppm dry volume corrected to 7% oxygen dry volume. The amount of ERC to be created for NOx emission will be 141 tons. The modification includes the adoption of PAH/PCB testing to follow the testing for dioxin/furan testing ( i.e. testing of one unit per year on a rotating basis per 40CFR60.38b) and the processing of the ash leachate from the adjacent Babylon monofill via injection into the spray dry adsorber.

In addition, a department-initiated modification is incorporated into the draft permit to revise emission limits, operating practices and performance testing and monitoring due to changes made to 40 CFR Part 60 Subpart Cb on May 10, 2006. The emission limits for cadmium, lead, mercury, and particulate matter were revised downward. Other major revisions include changes to operator stand-in provisions and continuous emissions monitoring data availability. These emission limits were revised based on year 2000 to 2005 test data from more than a dozen municipal waste combustor units.

In accordance with 6NYCRR Parts 621.7(b)(9) and 201-6.4(c), the Administrator of the United States Environmental Protection Agency (USEPA) has the authority to bar issuance of any Title V Facility Permit if it is determined not to be in compliance with applicable requirements of the Clean Air Act or 6NYCRR Part 201.
