Project Description:

The department has made a tentative determination to approve this application for the modification of an existing permit for the discharge of up to 11,690 GPD of treated sanitary wastewater to the St. Lawrence River from a new sand filter system which is a replacement in kind.

A cultural resources survey has been completed. Based on information provided in the survey report, the New York State Office of Parks, Recreation and Historic Preservation (OPRHP) has determined that the proposed activity will have no impact on registered or eligible archaeological sites or historic structures. No further review in accordance with SHPA is required.

Coastal Management:

This project is not located in a Coastal Management area and is not subject to the Waterfront Revitalization and Coastal Resources Act.

Project Description:

The applicant proposes to reconstruct a breached dam at his property on Miller Brook, off the Moose River Road, three miles east of the Village of Port Leyden. The dam failed in 2005 during a significant storm event, and the failure of an upstream dam causing significant flood flow conditions. The dam would be reconstruced at the same elevation and would impound approximately 4.5 acres with a maximum depth of approximately 10'. The dam design has been prepared by a licensed engineer and oversight of construction would be under the control of the engineer.
