Project Description:

The applicant proposes to modify their permit by adding 6.2 acres to the life of mine. This mining operation consists of a 157.8 acre limestone quarry within a 176.0 acre parcel on Rasbach Road in the Town of Litchfield. The project site is located approximately three miles east of the Village of Clayville, New York and approximately a quarter mile southwest of Days Corners. Mining is not proposed for below the local water table within the 6.2 acre expansion. Final reclamation will restore the site to 4.0 acres of meadow or brushland and 2.2 acres of forested land. Reclamation will include re-seeding with an approved USDA SCS seed mixture. The total reviewed expansion area is 6.2 acres. No excavation will be taking place within the 6.2 expansion acres: 2.2 acres will be used for the disposition of mining spoil and 4 acres involves the inclusion of existing ancillary buildings.

State Environmental Quality Review (SEQR) Determination:

Project is a Type I action and will not have a significant effect on the environment. A coordinated review with other agencies was performed and a Negative Declaration is on file.

SEQR Lead Agency: NYS Department of Environmental Conservation

State Historic Preservation Act (SHPA) Determination:

Cultural resource lists and map have been checked. No registered, eligible or inventoried archaeological sites or historic structures were identified at the project location. No further review in accordance with SHPA is required.

Coastal Management:

This project is not located in a Coastal Management area and is not subject to the Waterfront Revitalization and Coastal Resources Act.

Opportunity for Public Comment:

Comments on this project must be submitted in writing to the Contact Person no later than June 2, 2008.

Project Description:

The New York State Department of Environmental Conservation (NYSDEC) is pursuing a Department Initiated Modification (DIM) to the State Pollutant Discharge Elimination System (SPDES) Permit (NY 000 3042, DEC Identification #: 6-4062-00027), APC Paper Company of New York - Norfolk Plant pursuant to 6 NYCRR Part 750-1.18, New York State's Environmental Benefit Permit Strategy (EBPS). The changes to the permit are as follows:

Production rate increased to 147 tons per day (tpd) from 125 tpd. BOD levels are based on the proposed production rate. TSS levels are not increased because of regional fisheries' concern for deposition on spawning beds of an active walleye fisheries. The modification also includes several other minor reporting modifications. The APC Paper Company of New York - Norfolk Plant has surface discharge into the Raquette River, a class B water.

Additional information including the current permit, renewal applications, and supporting documentation may be obtained from or inspected at the DEC central office in Albany. Substantive comments on the permit or requests for hearing or both must be submitted in writing to the contact person. DEC seeks comments on the proposed regulated activity prior to making a final decision on permit issuance.

The proposed activity is not subject to review in accordance with SHPA. The permit type is exempt or the activity is being reviewed in accordance with federal historic preservation regulations.

Coastal Management:

This project is not located in a Coastal Management area and is not subject to the Waterfront Revitalization and Coastal Resources Act.
