Project Description:

The addition of 11.86 acres to the existing, currently permitted 166.86 acre Lippert Gravel Pit is proposed, on property located north of South Nine Mile Road and east of and contiguous with the previously permitted/mined area. Of the proposed expansion acreage, 2.29 acres consists of an area set-back from the east property line for the previously permitted Montanye Property, and 9.57 acres of adjacent land to the east, which is currently owned by Norra Barie. Excavation below the ground water table is proposed, which combined with the previously permitted reclamation plan, will make one lake approximately 34.69 acres in size. The material will be hauled to the existing processing area located approximately 0.6 miles southwest of the expansion area. Lake shores and surrounding disturbed area will be graded for stablity and revegetated with perennial grasses and legumes. The estimated life of the expansion is 1.5 years.

State Environmental Quality Review (SEQR) Determination:

Project is a Type I action and will not have a significant effect on the environment. A coordinated review with other agencies was performed and a Negative Declaration is on file.

SEQR Lead Agency: NYS Department of Environmental Conservation

State Historic Preservation Act (SHPA) Determination:

A cultural resources survey has been completed. Based on information provided in the survey report, the New York State Office of Parks, Recreation and Historic Preservation (OPRHP) has determined that the proposed activity will have no impact on registered or eligible archaeological sites or historic structures. No further review in accordance with SHPA is required.

Coastal Management:

This project is not located in a Coastal Management area and is not subject to the Waterfront Revitalization and Coastal Resources Act.

Opportunity for Public Comment:

Comments on this project must be submitted in writing to the Contact Person no later than May 23, 2008.

Project Description:

The NYS Department of Environmental Conservation proposes to modify State Pollutant Discharge Elimination System (SPDES) Permit No. NY-0020826 for the existing discharge of 0.5 million gallons per day of treated sanitary wastewater from the North Chautauqua Sewer District Wastewater Treatment Facility (WWTF) to Chautauqua Lake and Mud Creek. The facility will be installing an ultra-violet light disinfection system. Therefore, the draft permit will remove Chlorine (total residual) from the monitoring requirement. The North Chautauqua Sewer District WWTF is located on Clark Street in the Village of Mayville. The draft permit and supporting documents are available for review and comment at the address below. Refer to this application by the application number listed above and by SPDES No. NY-0020826.
