Project Description:

The applicant proposes to construct a 132 linear foot stone wall at the high water mark that is 10' wide and 8' tall with 4' of the wall being constructed below the existing grade. The newly constructed wall is proposed to be backfilled with 855 cu. yds. of clean fill. These activities are proposed within the adjacent area of NYSDEC regulated tidal wetlands associated with South Oyster Bay. The purpose of the project is to provide shoreline stabilization. The proposed project is located at 46 Riviera Drive South in Massapequa, Town of Oyster Bay in Nassau County, NCTM# 02-227-17.

Project Description:

The Department has reviewed Caithness Long Island Energy Center's application to modify its State Facility Permit to include conditions recently promulgated under regulations 6 NYCRR Parts 243, 244, and 245. These regulations require facilities to obtain/possess at least as many 'allocations' of sulfur dioxide (SO2) and oxides of nitrogen (NOx) as they emit into the atmosphere during a specified period of time. An 'allocation' is a unit of pollution which is limited by a budget established by the regulations. The Department developed these regulations in response to the United States Environmental Protection Agency's (EPA's) recent "Clean Air Interstate Rule" (CAIR). The regulations are included in New York's ' State Implementation Plan' (SIP) which has been approved by EPA as required by the Clean Air Act of 1990. The Department has made a tentative decision to approve this application and a draft permit is available for review the DEC Region 1 office.
