As part of the applicant's County Route 37 reconstruction project the applicant proposes to replace four (4) manufactured block retaining wall bridge wingwalls with cast-in-place concrete wingwalls on Bebee Creek (a.k.a Gates Creek), a Class C waterway. Also, the applicant proposes to install approximately 465 linear feet of longitudinal peak stone fill to stabilize the County Road 37 embankment along Honeoye Creek, a Class C waterway. Lastly, the applicant proposes to change the slope on a vegetated roadway embankment from 2H:1V to 3H:1V to increase the embankment's stability. The embankment work would be located within the NYS Freshwater Wetland (HO-4) adjacent area and would impact a section of land owned and managed by NYSDEC, the Honeoye Creek State Wildlife Management Area.

Project Description:

The Department has made a tentative determination to issue a modification to Mizkan Americas, Inc. SPDES permit which authorizes the discharge of treated process food waste and boiler blowdown to lagoons and spray irrigation fields (outfall 001), and non-contact cooling water and stormwater to tributary Ontario 140 (outfall 002). The modification includes an increase in flow to 0.019 million gallons per day (GPD) to outfall 001 and to 660 GPD to outfall 002. Chronic toxicity testing will be added to the permit to evaluate the use of water treatment chemicals. An additional lagoon and spray fields will be constructed adjacent to the lagoon and spray fields on West Ave at Marshall Road, due east of the vinegar plant on West Avenue. The new spray fields will employ filter strips; new Best Management Practices will be added to the permit to reflect this practice. The draft permit and project files are available for review and comment at NYSDEC Region 8.

Project Description:

Garlock Inc has submitted an application for renewal of its Title V Facility Permit, originally issued August 8, 2001, for the Garlock Sealing Technologies Facility, a mechanical packing manufacturing plant. The facility produces and tests gaskets, expansion joints, and molded speciality products. Facility operations include solvent mixing of rubber and plastic components, extrusion, molding, pressing, drying, curing, grinding, coating, product testing, and solvent storage. Process steam and heat are provided by one of two boilers with heat input capacities of 110.8 and 83.1 million BTU per hour, fired by natural gas or No. 2 fuel oil.

The facility is required to maintain a Title V Facility Permit as specified in 6 NYCRR Part 201-6, due to potential emissions in excess of Title V applicability thresholds of 50 tons per year of volatile organic compounds (VOC), 10 tons per year of individual hazardous air pollutant (HAP) compounds, and 25 tons per year of all HAP compounds combined.

As in the initial Title V Facility Permit, the Draft Title V Facility Permit generated by the Department for renewal includes conditions to limit boiler emissions of NOX to 67.5 tons per year, based on Emission Reduction Credits (ERC) created from over-control of NOX emissions from boiler operation, as specified in 6 NYCRR Part 231-2.6 New Source Review in Ozone Transport regions.

The Department has prepared a draft permit and has made a tentative determination to renew the Title V Facility Permit.

In accordance with 6NYCRR Parts 621.7(b)(9) and 201-6.4(c), the Administrator of the United States Environmental Protection Agency (USEPA) has the authority to bar issuance of any Title V Facility Permit if it is determined not to be in compliance with applicable requirements of the Clean Air Act or 6NYCRR Part 201.

Persons wishing to inspect the subject Title V files, including the application with all relevant supporting materials, the draft permit, and all other materials available to the DEC (the "permitting authority") that are relevant to this permitting decision should contact the DEC representative listed below.
