Project Description:

The applicant proposes to seasonally moor a floating freshwater swimming pool constructed within an 80-foot by 260-foot barge off Barretto Point Park in The Bronx from mid-June through mid-September (this period includes set-up and take-down activities) in three consecutive years starting in 2008. The pool barge would be operated during the traditional New York City swimming season, from July 1 through Labor Day weekend, and be open to the public free of charge. In addition to the pool, the barge contains ancillary facilities including showers, potable water and changing areas. The barge draws 4.6 feet of water and would be moored about 114 feet from the shoreline as it exists at mean high water. Six lines attached to fluke anchors in the botton sediment would anchor the barge. The barge would be accessed by two, 140-foot-long, 7-foot-wide gangways extending to temporary shoreline platform structures straddling an existing asphalt path above mean high water. Utilities (water, sewer, electric) would be routed from the park under the gangways to the barge. During the off-season period, from mid-September through mid-June, the barge would be removed and relocated out of New York State waters. This is a pilot project coupled with a water quality improvement project. It is designed as a temporary transitional measure only, toward achievement of swimmable marine waters at an appropriate publicly accessible location that would serve the same community.

Project Description:

The Department has prepared a draft permit and has made a tentative determination to issue a Title V Permit modification to include conditions of the recently promulgated regulations of 6 NYCRR Part 243. This regulation requires facilities to obtain/ possess at least as many "allocations" of sulfur dioxide (SO2) and oxides of nitrogen (NOx) as they emit into the atmosphere during a specified period of time. The Narrows Generating Station produces electricity; it operates 16 combustion turbines located on two barges. Each combustion turbine is rated at 297 mmbtu/hr and combust distillate oil and natural gas. The NOx emissions are greater than or equal to 25 tons per year on a 12 month rolling period and the facility is subject to 6 NYCRR Subpart 201-6 Title V Facility Permits requirements.

In accordance with 6NYCRR Parts 621.7(b)(9) and 201-6.4(c), the Administrator of the United States Environmental Protection Agency (USEPA) has the authority to bar issuance of any Title V Facility Permit if it is determined not to be in compliance with applicable requirements of the Clean Air Act or 6NYCRR Part 201.

Persons wishing to inspect the subject Title V files, including the application with all relevant supporting materials, the draft permit, and all other materials available to the DEC (the "permitting authority") that are relevant to this permitting decision should contact the DEC representative listed below. The Gowanus Generating Station is an energy generating power plant that uses distillate oil and natural gas for its 32 combustion turbines, each rated at 299 mmbtu/hr. The Oxides of Nitrogen emissions is equal or greater than 25 tons per year on a 12-month rolling period and the facility is subject to 6 NYCRR Subpart 201-6 Title V Facility Permit requirements.
