Project Description:

The Department has prepared a draft Air State Facility Permit and has made a tentative determination to issue this application to construct and operate a 110 million gallon per year dry mill ethanol production facility at the location of the former Con Agra plant. The operation will use #2 yellow corn to produce ethanol with dry distillers grain as a byproduct to be used as animal feed. The Permit will enforce emissions caps to limit Nitrogen Oxides and Carbon Monoxide to below 100 tons per year each and Volatile Organic Compounds to below 50 tons per year. Two Anguil Environmental Systems Regenerative Thermal Oxidizers are proposed as part of the operation for emissions control. The Permit will also limit emissions of acrolein, formaldehyde and phosphine to meet the requirements of the NYS air toxics program. By accepting these limitations, the facility will not require a Title V Permit. The permit also requires the facility to perform and submit an annual evaluation of greenhouse gas emission reduction technologies. Greenhouse gas control technologies may be implemented if deemed economically feasible and commercially practicable.

This project is subject to the Department's Environmental Justice Policy and an enhanced public participation plan has been prepared and accepted as a component of application completeness. As part of the plan, a document repository has been established near the project area that contains application and project related materials. Information on the repository location and other outreach components of the plan is available from the identified DEC contact.

State Environmental Quality Review (SEQR) Determination:

Project is a Type I action and will not have a significant effect on the environment. A coordinated review with other agencies was performed and a Negative Declaration is on file.

SEQR Lead Agency: Buffalo City Planning Board

State Historic Preservation Act (SHPA) Determination:

A cultural resources survey has been completed. Based on information provided in the survey report, the New York State Office of Parks, Recreation and Historic Preservation (OPRHP) has determined that the proposed activity will have an impact on registered or eligible archaeological sites or historic structures. The department must consult further with OPRHP before making a final decision regarding the issuance of the permit.

Coastal Management:

This project is located in a Coastal Management area and is subject to the Waterfront Revitalization and Coastal Resources Act.

Opportunity for Public Comment:

Comments on this project must be submitted in writing to the Contact Person no later than May 09, 2008.

Project Description:

This application is for the construction and operation of a proposed septage holding tank facility to temporarily store domestic septage. The facility will consist of two 750-gallon precast concrete tanks with locking covers located approximately 3000 feet east of the intersection of Route 77 and Beaver Meadow Road.

The proposed activity is not subject to review in accordance with SHPA. The permit type is exempt or the activity is being reviewed in accordance with federal historic preservation regulations.

Coastal Management:

This project is not located in a Coastal Management area and is not subject to the Waterfront Revitalization and Coastal Resources Act.
