Project Description:

The project involves dredging 820 linear feet of Kenyon Creek, a class C(T) tributary to the West Canada Creek, also class C(T). The project will restore the original creek channel which is presently dry. The restored channel will not exceed 10' in width or 3' in depth and will be constructed with side slopes of 2' vertical: 1' horizontal. A portion of the property is located in the floodplain (base flood elevation 569.0'.) Excavated materials will be used on-site for the construction of a new access road to the property however the roadway will not extend into the floodplain. For work below base flood elevation, all excavated materials will be immediately removed and there will be no temporary stockpiling of material in the floodplain during any phase of the project.

Project Description:

The Department has received a request for a permit to construct and operate air pollution sources and has drafted pursuant to Article 19 (Air Pollution Control) of the Environmental Conservation Law, a State Facility Permit, for the C & C Asphalt facility located at Whitaker Road between State Routes 12 & 26 Martinsburg, New York 13361. This facility is engaged in the production of asphaltic concrete utilized in paving projects. The Standard Industrial Classification representative of this facility is 2951, Paving Mixtures and Blocks.
This permit allows for the construction and operation of a 167 ton per hour Barber-Greene asphaltic concrete batch plant, rotary aggregate dryer with baghouse, liquid asphalt storage, aggregate hoppers and conveyor, a 693 horsepower Caterpillar diesel engine/generator, and a fuel oil storage tank.
The facility has accepted a limit on the quantity of asphaltic concrete that it can produce during any consecutive 12 month period. Additionally the facility has accepted a limit on the number of hours that the Caterpillar diesel generator can operate during any consecutive 12 month period. By accepting these limitations the facility emissions for Carbon Monoxide (CO), Sulfur Dioxide (SO2), Particulate Matter less than 10 microns (PM-10), Oxides of Nitrogen (NOx), Volatile Organic Compounds (VOC), and Hazardous Air Pollutants (HAP) will be less than their respective major source thresholds. The facility must meet the sulfur in fuel oil limits of 6 NYCRR Part 225-1, the opacity and particulate emission limits of 6 NYCRR Part 212, and the New Source Performance Standards for Hot Mix Asphalt Facilities of 40 CFR 60 Subpart I, in addition to the operating limits mentioned above.
The draft permit with conditions and application are available for review in the Region 6 NYS DEC office in Watertown, New York.

State Historic Preservation Act (SHPA) Determination:

A cultural resources survey has been completed. Based on information provided in the survey report, the New York State Office of Parks, Recreation and Historic Preservation (OPRHP) has determined that the proposed activity will have an impact on registered or eligible archaeological sites or historic structures. The department must consult further with OPRHP before making a final decision regarding the issuance of the permit.

Coastal Management:

This project is not located in a Coastal Management area and is not subject to the Waterfront Revitalization and Coastal Resources Act.
