Project Description:

The Department has received an application to modify an existing storage lagoon to hold whey and other food processing wastes prior to land application at the Hi Vu Acres facility located at 3890 Batavia/Elba Townline Road in the Town of Batavia. An existing lagoon will be modified and lined with compacted soil for the purpose of temporary whey storage when fields are not accessible for land application. The proposed design capacity for the lagoon is 1,102,000 gallons. Monitoring wells will be in place to detect any impact to groundwater resources. This application also includes a variance request from the required 1,500 foot horizontal separation distance between the storage facility and nearby residences.
The Department has made a tentative determination to approve this application. As a tentative determination, the Department is seeking public comment prior to making a final decision on permit issuance.

The Department has made a tentative determination to issue a permit modification to he Village of Holly's SPDES permit for the Sewage Treatment Plant which discharges 45 million gallons per day of treated sanitary effluent to the East Branch of Sandy Creek. The permit modification includes the elimination of the SPDES mini-pretreatment program and sampling requirements for the stormwater associated with the Superfund cleanup at DIAZ due to completion of the remediation and 3 months of non-detection of parameters. Project Description:

Evans Chemetics LP has submitted an application for an Air State Facility Permit to replace its Title V Facility Permit for its Evans Chemetics facility, located at 228 E Main St in the Village of Waterloo. The facility emits air contaminants from the synthesis of organic sulfur intermediates used in the cosmetic, pharmaceutical, and plastic industries, and from two natural gas fired process and heating steam boilers.
The facility was subject to 6 NYCRR Part 201-6, Title V Facility Permits for major stationary sources, due to potential emissions in excess of 100 tons per year of sulfur dioxide (SO2), 10 tons per year of an individual hazardous air pollutant (HAP), and 25 tons per year of all HAP compounds combined. The Title V Permit, originally issued August 1, 2000, also included restrictions on volatile organic compound (VOC) emissions to below the Part 212.10 VOC Reasonably Available Control Technology (RACT) threshold of 50 tons per year, and oxides of nitrogen (NOX) emissions to below the Part 227-2 NOX RACT threshold of 100 tons per year.
Replacement of 3 fuel oil fired boilers with 2 natural gas fired boilers at the facility has reduced potential SO2 emissions to less than 10 tons per year, and potential NOX emissions to less than 40 tons per year.
As part of its Air State Facility application, Evans Chemetics has proposed to restrict emissions to below Title V thresholds of 25 tons per year total HAP, and 10 tons per year each of individual HAP compounds, and also to continue the restriction on facility VOC emissions to below 50 tons per year, the Title V threshold as well as the RACT threshold indicated above.
Evans has proposed process changes to restrict HAP emissions, by directing methyl isobutyl ketone (MIBK) solvent emissions from two organic synthesis production processes to refrigerated condensers for recovery, with the gas stream leaving the condensers being directed to the air intake of a natural gas fired boiler for 95 percent destruction of the unrecovered MIBK.
In response, the Department has generated a Draft Air State Facility Permit with conditions specifying the changes in operations indicated above, and requiring process monitoring and record keeping sufficient to demonstrate compliance.
In addition, the facility remains subject to the 0.01 ppm Hydrogen Sulfide concentration standard in Part 257-10.
