Project Title: Champlain Vista Estates

Project Description: The project is the subdivision of 310 ± acres into six lots, creating five new building lots ranging in size from 10 ± acres to 60 ± acres and a 165 ± acre "Common Land" parcel owned by the proposed Champlain Vista Estates Homeowners Association, Inc. (HOA). All of the owners of the individual building lots will be subject to the burdens and benefits of a proposed Declaration of Protective Covenants, Conditions, Restrictions, Charges and Liens for the HOA. One new single family dwelling, guest cottage, garage and other accessory use structures serviced by a well and on-site wastewater treatment system are proposed for each of the five new building lots. The applicant proposes that, pursuant to the HOA, among other things, the collective size of the dwelling, guest cottage and garage, must be at least 3,000 square feet but may not exceed 8,000 square feet. The applicant also proposes, pursuant to the HOA that no structure may have more the 2½ stories or exceed 35 feet in height. Access to the building locations on each lot will be by individual driveways and a private subdivision road maintained by the HOA . Five lean-tos and one hunting and fishing cabin are proposed for the 165 ± acre common parcel.

Project Title: General Permit for "Management of Aquatic Invasive Plants Using Benthic Barriers and Hand Harvesting Techniques".
Location: Individual landowner properties and certain State lands not subject to State Land Master Plan or Unit Management Plan guidelines for management use.

Project Description: The Adirondack Park Agency (APA) proposes to provide a simplified process for qualified lake associations, local municipalities and the Adirondack Invasive Plant Program (APIPP) to obtain a permit for control of aquatic invasive plants using benthic barriers and hand harvesting techniques in APA regulated wetlands. This general permit, if approved, will be in effect for a five-year period. This general permit is issued pursuant to ECL Article 24 and §809(13)(e) of the Adirondack Park Agency Act and 9NYCRR §572.23.
In order to utilize this general permit, each applicant must submit a completed and signed "Application and Certification for Management of Aquatic Invasive Plants Using Benthic Barriers and Hand Harvesting Techniques." Agency staff will review the application for completeness, conduct a site visit if necessary and determine if the proposed project meets the terms and conditions of this general permit. If approvable, authorized APA representatives will sign and return to the applicant the "Application and Certification" form. The applicant may not begin aquatic invasive plant management activities until the Agency signed permit has been received.
The finding of fact, conclusions of law and mitigating conditions to address potential adverse environmental impacts and the statutory criteria for permit issuance can be found in the draft General Permit. A motion to adopt this general permit will be made at the May 8, 2008, Agency Board meeting.
Regulated Activities Subject to this General Permit
This general permit authorizes, on conditions, the following regulated activities occurring in APA-regulated wetlands where the activities could substantially impair regulated wetlands:
1. Allows the use of benthic barriers and hand harvesting techniques to control aquatic invasive plants in water depths less than 2 meters (6.6 feet).
2. Only authorizes the control of aquatic invasive plants including Eurasian watermilfoil (Myriophyllum spicatum), curlyleaf pondweed (Potamogeton crispus), water chestnut (Trapa natans), yellow floating heart (Nymphoides peltata), European frog-bit (Hydrocharis morsus-ranae), fanwort (cabomba caroliniana), and those species identified by the Supervisor, Resource Analysis and Scientific Services (RASS) Division.
3. The control is part of a lake wide aquatic plant management effort by a qualified lake association, local municipality, or APIPP.
4. Control activities can only occur on privately owned waterbodies or waterbodies owned by the State of New York and under the jurisdiction of NYS Office of General Services.
5. The General Permit does not apply to lands underwater determined to be NYS Forest Preserve.
6. Does not obviate the need to apply for and receive permits that may be required by other regulatory agencies.
State Environmental Quality Review Act (SEQRA)
This action is a SEQRA, Type 1 action. A negative declaration and Full Environmental Assessment Form has been prepared by the Agency and is on file at its offices in Ray Brook, New York. The SEQRA process has been completed.
Negative Declaration
Essex County - The Town of Willsboro, as lead agency, has determined that the proposed Black Ash Brownfield Remediation and Streambank Stabilization will not have a significant adverse environmental impact. The action involves the consolidation and encapsulation of Black Ash Residue to be spread over 16 ± acres of town land and to stabilize 2,300 linear feet of Boquet River Streambank. The project is located on School Street in the Town of Willsboro, New York.
