Project Description:

The Department has made a tentative determination to issue a permit modification to the Village of Holly's SPDES permit for the Sewage Treatment Plant which discharges 45 million gallons per day of treated sanitary effluent to the East Branch of Sandy Creek. The permit modification includes the elimination of the SPDES mini-pretreatment program and sampling requirements for the stormwater associated with the Superfund cleanup at DIAZ due to completion of the remediation and 3 months of non-detection of parameters. As a tentative determination, the Department is seeking comments prior to making a final decision. The file is available for review and comment at NYSDEC Regon 8.

Project Description:

The New York State Department of Environmental Conservation (NYS DEC) is pursuing a Department Initiated Modification (DIM) and renewal to the State Pollutant Discharge Elimination System (SPDES) Permit (NY 000 1007, DEC Identification #: 8-4672-00011/00001), the Pleasant Valley Wine Company pursuant to 6 NYCRR Part 750-1.18, New York State's Environmental Benefit Permit Strategy (EBPS).

The changes to the permit are as follows:

Updated Facility Information (Permittee Name, Facility Name, Discharge Monitoring Report (DMR) Information, Contact Person) on Page 1 of Permit. Based on past performance of the wastewater treatment plant, limits for Total Suspended Solids (TSS) have been reduced, from 280lb/d (avg) and 560lb/d (max) to 73lb/d (avg) and 164lb/d (max). Also added monitoring requirement for TSS so that TSS will be reported in mg/l on the DMR?s in addition to lbs per day. A Compliance Schedule was added to the permit requiring a short term high intensity monitoring program for Bis(2-ethylhexy)phthalate as a result of information contained in NY2C Application. Best Management Practices Requirements were added to the permit. Discharge Notification Requirements Page were added to the permit.

The modification also includes several other minor reporting modifications. The Pleasant Valley Wine Company has surface discharge into a tributary of Cold Brook, a class C water.

Additional information including the current permit, renewal applications, and supporting documentation may be obtained from or inspected at the DEC central office in Albany. Substantive comments on the permit or requests for hearing or both must be submitted in writing to the contact person. DEC seeks comments on the proposed regulated activity prior to making a final decision on permit issuance.
