Project Description:

The Department has drafted a permit renewal pursuant to Article 19 (Air Pollution Control) of the NYS Environmental Conservation Law and Title V of the Federal Clean Air Act Amendments and has made a tentative determination to approve the renewal application for the applicant's existing pharmaceutical plant. The draft permit contains no new or significant increases in potential emissions. Compliance certification activities associated with Active Particulate Ingredients (APIs) have been revised to better provide reasonable compliance assurance. Also, several API control devices will be upgraded to further mitigate potential ambient impacts. The draft permit also includes increased periodic monitoring for a number of VOC and particulate sources. In addition, an Operational Flexibility Plan has been added to the Title V permit. This maximizes operational flexibility by building in the capability to make certain changes using a protocol. Changes made under the approved protocol are not subject to the Title V permit modification provisions under 6 NYCRR Part 201-6.7.

In accordance with 6NYCRR Parts 621.7(b)(9) and 201-6.4(c), the Administrator of the United States Environmental Protection Agency (USEPA) has the authority to bar issuance of any Title V Facility Permit if it is determined not to be in compliance with applicable requirements of the Clean Air Act or 6NYCRR Part 201.

Persons wishing to inspect the subject Title V files, including the application with all relevant supporting materials, the draft permit, and all other materials available to the DEC (the "permitting authority") that are relevant to this permitting decision should contact the DEC representative listed below. DEC will evaluate the application and the comments received on it to determine whether to hold a public hearing. Project Description:

The Department has made a tentative determination, in accordance with its Environmental Benefit Permit Strategy, to modify the State Pollutant Discharge Elimination System (SPDES) permit for the AuSable Forks Community Wastewater Treatment Facility. The existing permitted facility is a secondary treatment plant, located at 215 Grove Road in the Town of Jay, with a design flow discharge of 147,000 gallons per day of sanitary wastewater to the AuSable River, a Class C Stream. The permit is being modified to add an effluent limit for phosphorus (4.47 lbs/day, 12 month rolling average) in accordance with the Lake Champlain phosphorus Total Maximum Daily Load (TMDL) limit requirement. This tentative determination indicates that the discharge regulated under this statute is considered to satisfy regulatory standards for permit issuance, based on information available to the Department at this time. As a tentative determination, the Department seeks comments on the proposed modification prior to making a final decision. The draft permit (SPDES # NY-002 7760) is available for review by making an appointment with the contact person listed below.

Project Description:

The applicant proposes to apply the aquatic herbicide Sonar A.S. (active ingredient: fluridone- 41.7%) to Glen Lake to control Eurasion Water Milfoil (Myriophyllum spicatum). The application area includes portions of regulated Freshwater Wetlands GF-21 (Class II) and GF-15 (Class I). This proposal is consistent with the Programmatic Environmental Impact Statement On Aquatic Vegetation Control Program of the Department of Environmental Conservation and its Findings. Glen Lake is an approximately 320 acre lake located on Glen Lake Road, east of State Route 9.
