Project Description:

The New York State Department of Environmental Conservation (NYSDEC) is pursuing a Department Initiated Modification (DIM) to the State Pollutant Discharge Elimination System (SPDES) Permit (NY 000 4596, DEC Identification #: 2-6101-00055/00001-0), the BP Products North America - Brooklyn Terminal pursuant to 6 NYCRR Part 750-1.18, New York State's Environmental Benefit Permit Strategy (EBPS).

The changes to the permit are as follows:

Updated permit based on model permit for fuel storage facilities.
Removed MTBE, no longer used in gasoline. Water Quality limit for benzene applied to outfalls 01B and 01C at 10ug/l (20 ug/l in previous permit).
Added settleable solids at 0.1 ml/l to outfall 001.
Included dye dilution study.

The modification also includes several other minor reporting modifications. The BP Products North America - Brooklyn Terminal has surface discharge into Newtown Creek, a class SD water.

Additional information including the current permit, renewal applications, and supporting documentation may be obtained from or inspected at the DEC central office in Albany. Substantive comments on the permit or requests for hearing or both must be submitted in writing to the contact person. DEC seeks comments on the proposed regulated activity prior to making a final decision on permit issuance.

State Environmental Quality Review (SEQR) Determination:

Project is an Unlisted Action and will not have a significant impact on the environment. A Negative Declaration is on file. A coordinated review was not performed.

SEQR Lead Agency: None Designated

State Historic Preservation Act (SHPA) Determination:

The proposed activity is not subject to review in accordance with SHPA. The permit type is exempt or the activity is being reviewed in accordance with federal historic preservation regulations.

Coastal Management:

This project is not located in a Coastal Management area and is not subject to the Waterfront Revitalization and Coastal Resources Act.

Opportunity for Public Comment:

Project Description:

The Department has prepared a draft permit and has made a tentative determination to issue a new Air State Facility permit for a project consisting of the replacement of the existing Mother Clara Hale Depot which is used for the storage and maintenance of NYCT buses. The regulated sources will consist of two 10.2 mmBtu/hr hot water boilers with one operating and one standby capable of burning natural gas or no. 2 fuel oil. In addition, there will be two 2MW generators which will be operated for both maintenance testing and to provide electrical power to the depot under a peak load management (PLM) program The facility nitrogen oxides (NOx) emissions are limited to less than 22.5 tons per year. The facility is subject to the provisions of State Facility specified under 6NYCRR 201-7.2. The application, draft permit, relevant supporting materials and regulations are available for review during normal business hours at the DEC office provided in this notice. Comments of support or objection may be made by filing a written statement by the deadline date indicated. DEC may schedule a public hearing based upon an evaluation of the nature and scope of any written objections raised. Hearing notices will contain instructions on filing for party status and submitting comments.

This project is subject to the Department's Environmental Justice Policy and an enhanced public participation plan has been prepared and accepted as a component of application completeness. State Environmental Quality Review (SEQR) Determination:

Project is an Unlisted Action and will not have a significant impact on the environment. A Negative Declaration is on file. A coordinated review was performed.

SEQR Lead Agency: NYC Dept of Transportation

State Historic Preservation Act (SHPA) Determination:

A cultural resources survey has been completed. The report of the survey is on file. No archaeological sites or historic structures were identified at the project location. No further review in accordance with SHPA is required.

Coastal Management:

This project is not located in a Coastal Management area and is not subject to the Waterfront Revitalization and Coastal Resources Act.

Opportunity for Public Comment:

Comments on this project must be submitted in writing to the Contact Person no later than May 09, 2008.
