Project Description:

The applicant proposes the mining of gravel on approximately 1.8 acres out of 61 acres of property owned by Gregory Rater on the south side of Mannison Road. The estimated life of mine is 10 years and the reclamation objective is agriculture. The project site is located on the south side of Mannison Road, approximately 650 feet west of Mannison and Barcelona Roads intersection in the Town of Sherman, Chautauqua County.

State Environmental Quality Review (SEQR) Determination:

State Historic Preservation Act (SHPA) Determination:

Cultural resource lists and map have been checked. No registered, eligible or inventoried archaeological sites or historic structures were identified at the project location. No further review in accordance with SHPA is required.

Coastal Management:

This project is not located in a Coastal Management area and is not subject to the Waterfront Revitalization and Coastal Resources Act.

Opportunity for Public Comment:

Project Description:

The Chaffee Plant is located to the east of NYS Route 16, north of Cattaraugus Creek, west of Hurdville Road, and south of Schutt Road, in the Towns of Sardinia and Arcade. Approximately 167 acres of the 201 acre site have been impacted by sand and gravel mining, and the permitted reclamation plan was to restore the land to a condition suitable for agriculture. This application is a modification to the reclamation proposed in the mined land-use plan, to allow the reclaimed site to be used for multiple uses, including business, light industry and multi-family homes, as proposed by the new owner of the property, Mark 1 LLC. Changes to the reclamation plan include: The five on-site settling ponds constructed as part of the mining processing operation will remain; the main shop building and adjacent concrete transformer pad will remain; the entranceway and some internal haulageways will remain as access roads to and through the property; and construction of approximately 560 linear feet of bioengineering and rock riprap streambank erosion protection along Cattaraugus Creek. The proposed reclamation is consistent with the Town of Sardinia and Arcade zoning districts that affect the property.

State Historic Preservation Act (SHPA) Determination:

The proposed activity is not subject to review in accordance with SHPA. The permit type is exempt or the activity is being reviewed in accordance with federal historic preservation regulations.

Coastal Management:

This project is not located in a Coastal Management area and is not subject to the Waterfront Revitalization and Coastal Resources Act.
